答 根據我國勞(lao)動(dong)(dong)法(fa)(fa)的(de)規定(ding),勞(lao)動(dong)(dong)者可采(cai)取(qu)以下三(san)種方式解(jie)除勞(lao)動(dong)(dong)合同: 第(di)一,與用(yong)人單(dan)(dan)位協(xie)(xie)商一致解(jie)除勞(lao)動(dong)(dong)合同。采(cai)用(yong)這(zhe)種方式解(jie)除勞(lao)動(dong)(dong)合同,只要(yao)勞(lao)動(dong)(dong)者與用(yong)人單(dan)(dan)位就解(jie)除合同的(de)有關事項協(xie)(xie)商一致,就可以解(jie)除勞(lao)動(dong)(dong)合同,辦理離職手(shou)(shou)續(xu)。 第(di)二,提(ti)(ti)前30日以書面形(xing)式通知用(yong)人單(dan)(dan)位解(jie)除勞(lao)動(dong)(dong)合同。 第(di)三(san),有下列(lie)情形(xing)之一的(de),勞(lao)動(dong)(dong)者可隨時通知用(yong)人單(dan)(dan)位解(jie)除勞(lao)動(dong)(dong)合同: (1) 在試用(yong)期內的(de); (2) 用(yong)人單(dan)(dan)位以暴力(li)、威脅或非(fei)法(fa)(fa)限制(zhi)人身(shen)自(zi)由的(de)手(shou)(shou)段(duan)強迫勞(lao)動(dong)(dong)的(de); (3) 用(yong)人單(dan)(dan)位未按照(zhao)勞(lao)動(dong)(dong)合同約定(ding)支付(fu)勞(lao)動(dong)(dong)報(bao)酬或提(ti)(ti)供勞(lao)動(dong)(dong)條件的(de)。
