答 根據我國勞(lao)(lao)動(dong)(dong)(dong)法(fa)的(de)(de)規定(ding)(ding),勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)可采取(qu)以(yi)(yi)(yi)下(xia)三(san)種(zhong)(zhong)方(fang)式(shi)解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong): 第一,與用(yong)人(ren)單位(wei)協商一致解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。采用(yong)這種(zhong)(zhong)方(fang)式(shi)解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),只要(yao)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)與用(yong)人(ren)單位(wei)就解(jie)除(chu)(chu)合(he)同(tong)的(de)(de)有關事項協商一致,就可以(yi)(yi)(yi)解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),辦理離職手續。 第二(er),提前30日以(yi)(yi)(yi)書面形式(shi)通(tong)知用(yong)人(ren)單位(wei)解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。 第三(san),有下(xia)列情形之一的(de)(de),勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)可隨時(shi)通(tong)知用(yong)人(ren)單位(wei)解(jie)除(chu)(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong): (1) 在試(shi)用(yong)期內的(de)(de); (2) 用(yong)人(ren)單位(wei)以(yi)(yi)(yi)暴力(li)、威(wei)脅或非法(fa)限制人(ren)身自由的(de)(de)手段強迫勞(lao)(lao)動(dong)(dong)(dong)的(de)(de); (3) 用(yong)人(ren)單位(wei)未按(an)照(zhao)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)約定(ding)(ding)支(zhi)付勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)或提供(gong)勞(lao)(lao)動(dong)(dong)(dong)條件(jian)的(de)(de)。
