員工應當怎樣和企業解除勞動合同?

根據我國勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法的(de)(de)規定,勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)可采(cai)取以下三種方式(shi)解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong): 第一(yi),與(yu)用(yong)人(ren)單位協商(shang)一(yi)致解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)。采(cai)用(yong)這種方式(shi)解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong),只要勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)與(yu)用(yong)人(ren)單位就(jiu)解除合(he)同(tong)(tong)的(de)(de)有關事項(xiang)協商(shang)一(yi)致,就(jiu)可以解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong),辦理離職手續。 第二,提(ti)前30日以書(shu)面(mian)形式(shi)通知(zhi)用(yong)人(ren)單位解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)。 第三,有下列情形之一(yi)的(de)(de),勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)可隨時(shi)通知(zhi)用(yong)人(ren)單位解除勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong): (1) 在試用(yong)期內(nei)的(de)(de); (2) 用(yong)人(ren)單位以暴力、威脅或非法限制人(ren)身自(zi)由的(de)(de)手段強迫勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)的(de)(de); (3) 用(yong)人(ren)單位未按照勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)約定支(zhi)付(fu)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報(bao)酬(chou)或提(ti)供勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)條(tiao)件的(de)(de)。
