答 《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法》第17條(tiao)(tiao)(tiao)規(gui)(gui)定,勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)應當(dang)具備(bei)以下條(tiao)(tiao)(tiao)款: (一)用人單(dan)位的(de)名(ming)稱、住所和(he)法定代表(biao)人或者(zhe)主要負責人; (二(er))勞(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)姓名(ming)、住址和(he)居民(min)身份證(zheng)或者(zhe)其他有效身份證(zheng)件號碼; (三)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian); (四)工作內容(rong)和(he)工作地點; (五)工作時(shi)間和(he)休息(xi)休假; (六)勞(lao)(lao)動(dong)(dong)(dong)報酬(chou); (七)社會保險; (八)勞(lao)(lao)動(dong)(dong)(dong)保護(hu)(hu)、勞(lao)(lao)動(dong)(dong)(dong)條(tiao)(tiao)(tiao)件和(he)職(zhi)業危害防護(hu)(hu); (九(jiu))法律(lv)、法規(gui)(gui)規(gui)(gui)定應當(dang)納入勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)的(de)其他事(shi)項(xiang)。 勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)除(chu)前(qian)款規(gui)(gui)定的(de)必備(bei)條(tiao)(tiao)(tiao)款外,用人單(dan)位與勞(lao)(lao)動(dong)(dong)(dong)者(zhe)可以約定試用期(qi)、培(pei)訓、保守秘(mi)密、補(bu)充保險和(he)福利待遇等(deng)其他事(shi)項(xiang)。
