一般勞動合同應具備哪些條款?

最近,剛在(zai)山東一(yi)(yi)家權威的人才網站上(shang)找了(le)(le)份(fen)工作,下周一(yi)(yi)就(jiu)要去上(shang)班了(le)(le),想了(le)(le)解(jie)一(yi)(yi)些勞動(dong)合同的相關問題(ti),一(yi)(yi)般(ban)勞動(dong)合同應具備哪些條款?

勞動(dong)合同的條(tiao)(tiao)(tiao)款包括(kuo)必(bi)備(bei)(bei)條(tiao)(tiao)(tiao)款和(he)(he)約(yue)(yue)(yue)定(ding)條(tiao)(tiao)(tiao)款兩部(bu)分(fen),必(bi)備(bei)(bei)條(tiao)(tiao)(tiao)款有:   1.勞動(dong)合同期(qi)限(xian)。主(zhu)要分(fen)為有固定(ding)期(qi)限(xian)、無固定(ding)期(qi)限(xian)和(he)(he)以(yi)(yi)完(wan)成(cheng)一定(ding)的工(gong)(gong)作(zuo)為期(qi)限(xian)等(deng)三種(zhong)形式;   2.工(gong)(gong)作(zuo)內(nei)(nei)容。主(zhu)要包括(kuo)工(gong)(gong)種(zhong)和(he)(he)崗位(wei)(wei),以(yi)(yi)及(ji)(ji)該(gai)崗位(wei)(wei)應完(wan)成(cheng)的生(sheng)產(工(gong)(gong)作(zuo))勞務(wu)、工(gong)(gong)作(zuo)班次等(deng)內(nei)(nei)容;   3.勞動(dong)保(bao)(bao)護(hu)和(he)(he)勞動(dong)條(tiao)(tiao)(tiao)件。主(zhu)要包括(kuo)勞動(dong)安全(quan)和(he)(he)衛(wei)生(sheng)規(gui)程(cheng),女工(gong)(gong)和(he)(he)未(wei)成(cheng)年人的保(bao)(bao)護(hu)規(gui)定(ding),工(gong)(gong)作(zuo)時間和(he)(he)休息休假等(deng)內(nei)(nei)容;   4.勞動(dong)報酬。主(zhu)要包括(kuo)勞動(dong)者的工(gong)(gong)資(zi)、獎金、津貼和(he)(he)補貼等(deng)內(nei)(nei)容;   5.勞動(dong)紀律(lv)。主(zhu)要包括(kuo)企業規(gui)章(zhang)制度(du),勞動(dong)紀律(lv)等(deng)內(nei)(nei)容及(ji)(ji)其執行(xing)程(cheng)序;   6.勞動(dong)合同終止的條(tiao)(tiao)(tiao)件;   7.違反勞動(dong)合同的責任(ren)。   勞動(dong)合同除(chu)以(yi)(yi)上(shang)規(gui)定(ding)的必(bi)備(bei)(bei)條(tiao)(tiao)(tiao)款外,勞動(dong)合同當事(shi)人還(huan)可以(yi)(yi)通過協商訂立約(yue)(yue)(yue)定(ding)條(tiao)(tiao)(tiao)款。雙方(fang)當事(shi)人可以(yi)(yi)就用(yong)人單位(wei)(wei)出資(zi)招收(shou)錄(lu)用(yong)、出資(zi)培(pei)訓、勞動(dong)者保(bao)(bao)守用(yong)人單位(wei)(wei)商業秘密等(deng)事(shi)項,約(yue)(yue)(yue)定(ding)雙方(fang)的權(quan)利和(he)(he)義務(wu)。但雙方(fang)的約(yue)(yue)(yue)定(ding)條(tiao)(tiao)(tiao)款不(bu)能(neng)違背(bei)法律(lv)、法規(gui)和(he)(he)有關規(gui)章(zhang)的規(gui)定(ding)。
