“終止”與“解除”勞動合同是一回事嗎?

我是一名(ming)濟(ji)南的(de)職場新人,想大體了解一下(xia),“終止”與“解除”勞(lao)動合同是一回事嗎?

當然不是(shi)一回事(shi)了(le),根據勞(lao)動(dong)(dong)(dong)部有(you)(you)關規定(ding),勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)解除是(shi)指(zhi)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)訂立(li)后(hou),尚未全部履(lv)行以(yi)前(qian),由于(yu)某種(zhong)原因導致(zhi)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)一方(fang)或雙方(fang)當事(shi)人提前(qian)消滅勞(lao)動(dong)(dong)(dong)關系(xi)的(de)法律行為(wei)。勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)解除分為(wei)法定(ding)解除和約定(ding)解除兩種(zhong)。而勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)終止,是(shi)指(zhi)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)期(qi)限(xian)屆滿或者(zhe)有(you)(you)其他符合(he)(he)法律規定(ding)的(de)情形出現導致(zhi)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)關系(xi)消滅。按照《勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法》規定(ding),勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)終止只有(you)(you)法定(ding)情形的(de)終止,而不能有(you)(you)約定(ding)條(tiao)件(jian)下的(de)終止,否(fou)則(ze),即使約定(ding)了(le),也(ye)是(shi)無(wu)效的(de)。
