“終止”與“解除”勞動合同是一回事嗎?
問 我是一(yi)(yi)名(ming)濟南的職場新人,想大體了(le)解一(yi)(yi)下(xia),“終(zhong)止(zhi)”與“解除”勞動合同(tong)是一(yi)(yi)回事(shi)嗎?
答 當然不是(shi)(shi)一回(hui)事了,根據(ju)勞(lao)(lao)(lao)動(dong)部(bu)有(you)關(guan)(guan)規定(ding),勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)的解(jie)除(chu)是(shi)(shi)指(zhi)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)訂(ding)立后,尚(shang)未全(quan)部(bu)履行以(yi)前(qian),由(you)于某種原因導致勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)一方(fang)或(huo)雙方(fang)當事人提前(qian)消(xiao)滅(mie)勞(lao)(lao)(lao)動(dong)關(guan)(guan)系的法律行為。勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)的解(jie)除(chu)分為法定(ding)解(jie)除(chu)和約定(ding)解(jie)除(chu)兩種。而勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)的終止,是(shi)(shi)指(zhi)勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)期限屆滿或(huo)者有(you)其他符合(he)(he)法律規定(ding)的情形出(chu)現(xian)導致勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)關(guan)(guan)系消(xiao)滅(mie)。按照《勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)法》規定(ding),勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)的終止只有(you)法定(ding)情形的終止,而不能有(you)約定(ding)條件下(xia)的終止,否(fou)則,即使約定(ding)了,也(ye)是(shi)(shi)無效的。
