單位未與勞動者簽訂勞動合同時,如何證明勞動關系存在?

我是一名文員,剛剛找(zhao)到工作,想了解(jie)一些關于(yu)勞動(dong)(dong)(dong)法(fa)的知(zhi)識,單位未與(yu)勞動(dong)(dong)(dong)者簽訂(ding)勞動(dong)(dong)(dong)合同時,如何證明(ming)勞動(dong)(dong)(dong)關系存在?

答(da) 用(yong)(yong)人單位未與(yu)勞(lao)動(dong)(dong)(dong)者簽訂勞(lao)動(dong)(dong)(dong)合同,認定勞(lao)動(dong)(dong)(dong)關(guan)系(xi)時(shi)可參照(zhao)下(xia)列憑證(zheng): 1)工(gong)資支付憑證(zheng)或記(ji)錄(lu)(職工(gong)工(gong)資發放花名冊(ce))、繳納各項(xiang)社(she)會保險費的(de)(de)(de)記(ji)錄(lu); 2)用(yong)(yong)人單位向勞(lao)動(dong)(dong)(dong)者發放的(de)(de)(de)“工(gong)作證(zheng)”、“服務證(zheng)”等能夠(gou)證(zheng)明身(shen)份(fen)的(de)(de)(de)證(zheng)件;  3)勞(lao)動(dong)(dong)(dong)者填寫的(de)(de)(de)用(yong)(yong)人單位招工(gong)招聘“登記(ji)表(biao)”、“報(bao)名表(biao)”等招用(yong)(yong)記(ji)錄(lu); 4)考勤記(ji)錄(lu); 5)其他勞(lao)動(dong)(dong)(dong)者的(de)(de)(de)證(zheng)人證(zheng)言(yan)等。 6)其中,1)、3)、4)項(xiang)的(de)(de)(de)有(you)關(guan)憑證(zheng)由用(yong)(yong)人單位負責(ze)(ze)舉(ju)證(zheng)責(ze)(ze)任。
