答(da) 用人單(dan)位未與勞(lao)(lao)動(dong)者(zhe)簽訂(ding)勞(lao)(lao)動(dong)合同(tong),認定勞(lao)(lao)動(dong)關系時可(ke)參(can)照(zhao)下列憑(ping)證(zheng)(zheng)(zheng): 1)工(gong)(gong)資支付憑(ping)證(zheng)(zheng)(zheng)或記錄(lu)(職(zhi)工(gong)(gong)工(gong)(gong)資發放花名(ming)冊(ce))、繳納各項(xiang)社會保險(xian)費的記錄(lu); 2)用人單(dan)位向(xiang)勞(lao)(lao)動(dong)者(zhe)發放的“工(gong)(gong)作證(zheng)(zheng)(zheng)”、“服務證(zheng)(zheng)(zheng)”等(deng)能夠證(zheng)(zheng)(zheng)明身份的證(zheng)(zheng)(zheng)件;  3)勞(lao)(lao)動(dong)者(zhe)填(tian)寫的用人單(dan)位招(zhao)工(gong)(gong)招(zhao)聘“登記表(biao)”、“報名(ming)表(biao)”等(deng)招(zhao)用記錄(lu); 4)考勤記錄(lu); 5)其他(ta)勞(lao)(lao)動(dong)者(zhe)的證(zheng)(zheng)(zheng)人證(zheng)(zheng)(zheng)言等(deng)。 6)其中,1)、3)、4)項(xiang)的有關憑(ping)證(zheng)(zheng)(zheng)由用人單(dan)位負責舉證(zheng)(zheng)(zheng)責任。
