沒有簽訂勞動合同就可以得到雙倍工資嗎?

答 《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)82條第(di)1款規定:“用人(ren)單位自用工之日(ri)起超過一個月不滿(man)一年(nian)未與勞(lao)動(dong)(dong)(dong)者訂立(li)書(shu)(shu)面勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de),應當(dang)向(xiang)勞(lao)動(dong)(dong)(dong)者每月支付二(er)倍(bei)的(de)(de)工資。”上述關于未簽(qian)訂勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)支付雙倍(bei)工資的(de)(de)規定旨在督促用人(ren)單位在法(fa)定時間內主動(dong)(dong)(dong)履行(xing)與勞(lao)動(dong)(dong)(dong)者簽(qian)訂書(shu)(shu)面勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de)義務,穩定勞(lao)動(dong)(dong)(dong)關系(xi),否則(ze),用人(ren)單位將(jiang)付出相應的(de)(de)違法(fa)成本。你的(de)(de)情況就是這樣的(de)(de),所以(yi)你要督促你的(de)(de)上司(si)簽(qian)訂勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。
