沒有簽訂勞動合同就可以得到雙倍工資嗎?

答 《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法》第(di)82條(tiao)第(di)1款規(gui)定(ding):“用(yong)(yong)人單位自(zi)用(yong)(yong)工(gong)之日(ri)起超過一個月不滿一年(nian)未(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)訂(ding)(ding)立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的(de)(de)(de)(de),應當(dang)向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)每月支付二倍(bei)(bei)的(de)(de)(de)(de)工(gong)資。”上(shang)述關于未(wei)簽(qian)(qian)訂(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)支付雙倍(bei)(bei)工(gong)資的(de)(de)(de)(de)規(gui)定(ding)旨在督促用(yong)(yong)人單位在法定(ding)時(shi)間內(nei)主動(dong)(dong)(dong)(dong)履行與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)簽(qian)(qian)訂(ding)(ding)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的(de)(de)(de)(de)義務,穩定(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系,否則(ze),用(yong)(yong)人單位將(jiang)付出相(xiang)應的(de)(de)(de)(de)違法成本。你(ni)(ni)的(de)(de)(de)(de)情況就是(shi)這樣(yang)的(de)(de)(de)(de),所以你(ni)(ni)要(yao)督促你(ni)(ni)的(de)(de)(de)(de)上(shang)司簽(qian)(qian)訂(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。
