答(da) 《勞動(dong)(dong)(dong)(dong)合同法》第十六(liu)條規定:“勞動(dong)(dong)(dong)(dong)合同是(shi)勞動(dong)(dong)(dong)(dong)者與用人(ren)單(dan)位(wei)確立(li)(li)勞動(dong)(dong)(dong)(dong)關系、明確雙方權利和義務的(de)(de)協議(yi)。建(jian)立(li)(li)勞動(dong)(dong)(dong)(dong)關系應(ying)當訂立(li)(li)勞動(dong)(dong)(dong)(dong)合同。”因此(ci)公司不與員(yuan)工(gong)(gong)簽訂勞動(dong)(dong)(dong)(dong)合同是(shi)違(wei)法的(de)(de),員(yuan)工(gong)(gong)可(ke)以(yi)到單(dan)位(wei)所在地的(de)(de)勞動(dong)(dong)(dong)(dong)監察部(bu)門投訴解決,如果工(gong)(gong)作時間(jian)不超過一年,可(ke)以(yi)主張雙倍工(gong)(gong)資差額部(bu)分(fen)的(de)(de)返還。
