畢業工作一段時間遲遲不簽勞動合同怎么辦?

我是(shi)(shi)今年的應屆畢業(ye)生(sheng),現在工作了(le)三四個月(yue)了(le),但是(shi)(shi)單位遲(chi)遲(chi)不簽勞動合同怎(zen)么辦?

《勞(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)》第十六條規定:“勞(lao)動(dong)(dong)(dong)合同(tong)(tong)是勞(lao)動(dong)(dong)(dong)者(zhe)與用人單位確(que)立(li)(li)勞(lao)動(dong)(dong)(dong)關系(xi)、明確(que)雙(shuang)方(fang)權(quan)利和(he)義務的協議。建立(li)(li)勞(lao)動(dong)(dong)(dong)關系(xi)應當訂立(li)(li)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)。”因此(ci)公司不(bu)與員工(gong)(gong)簽訂勞(lao)動(dong)(dong)(dong)合同(tong)(tong)是違法(fa)的,員工(gong)(gong)可以到(dao)單位所在地的勞(lao)動(dong)(dong)(dong)監察部(bu)門(men)投訴解決,如果工(gong)(gong)作時間不(bu)超過一年,可以主張雙(shuang)倍工(gong)(gong)資(zi)差(cha)額部(bu)分的返還。
