超過1個月未簽合同單位需承擔什么責任?

我入職(zhi)新單位三個月(yue),多(duo)次提出要(yao)簽訂勞動合同,但(dan)人(ren)事都表示再等等,請問超(chao)過一個月(yue)未簽合同,單位需(xu)承擔(dan)什么責任?

根據《中華人民共和國勞(lao)動(dong)(dong)(dong)合(he)同法實施條例》:用(yong)(yong)人單(dan)位(wei)自用(yong)(yong)工(gong)之(zhi)日(ri)起(qi)(qi)超過一個月不滿一年未(wei)與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同的(de)(de),應(ying)當向勞(lao)動(dong)(dong)(dong)者(zhe)每月支(zhi)付二倍(bei)的(de)(de)工(gong)資,并與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)補訂(ding)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同。用(yong)(yong)人單(dan)位(wei)向勞(lao)動(dong)(dong)(dong)者(zhe)每月支(zhi)付兩倍(bei)工(gong)資的(de)(de)起(qi)(qi)算時間為用(yong)(yong)工(gong)之(zhi)日(ri)起(qi)(qi)滿一個月的(de)(de)次日(ri),截止時間為補訂(ding)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同的(de)(de)前一日(ri)。
