超過1個月未簽合同單位需承擔什么責任?

我入職(zhi)新單(dan)位三個月(yue)(yue),多次提出要簽訂勞(lao)動合同,但人事(shi)都表示再等等,請問(wen)超過一個月(yue)(yue)未(wei)簽合同,單(dan)位需(xu)承(cheng)擔什么(me)責(ze)任?

答(da) 根(gen)據《中華人(ren)民(min)共和國(guo)勞(lao)(lao)動(dong)(dong)合同(tong)法實施條例(li)》:用(yong)人(ren)單位自用(yong)工之日(ri)起超(chao)過一個(ge)月不滿(man)一年未與(yu)勞(lao)(lao)動(dong)(dong)者訂立書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong)的,應當向(xiang)勞(lao)(lao)動(dong)(dong)者每月支付(fu)二倍(bei)的工資,并與(yu)勞(lao)(lao)動(dong)(dong)者補訂書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong)。用(yong)人(ren)單位向(xiang)勞(lao)(lao)動(dong)(dong)者每月支付(fu)兩倍(bei)工資的起算時間(jian)為(wei)(wei)用(yong)工之日(ri)起滿(man)一個(ge)月的次(ci)日(ri),截止時間(jian)為(wei)(wei)補訂書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong)的前一日(ri)。
