超過1個月未簽合同單位需承擔什么責任?

我入職新單位(wei)三個月(yue),多次提出要簽訂勞動合同,但(dan)人(ren)事都表示再等(deng)等(deng),請(qing)問超過一個月(yue)未簽合同,單位(wei)需承(cheng)擔什(shen)么責(ze)任?

答(da) 根(gen)據(ju)《中華人民(min)共和國勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法實施條例(li)》:用(yong)人單(dan)位自用(yong)工(gong)之日(ri)(ri)起超(chao)過(guo)一(yi)個月(yue)不滿一(yi)年未與勞(lao)(lao)(lao)動(dong)(dong)者訂立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的(de),應(ying)當向勞(lao)(lao)(lao)動(dong)(dong)者每月(yue)支付(fu)二(er)倍(bei)的(de)工(gong)資(zi),并與勞(lao)(lao)(lao)動(dong)(dong)者補訂書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。用(yong)人單(dan)位向勞(lao)(lao)(lao)動(dong)(dong)者每月(yue)支付(fu)兩倍(bei)工(gong)資(zi)的(de)起算時間為用(yong)工(gong)之日(ri)(ri)起滿一(yi)個月(yue)的(de)次日(ri)(ri),截止時間為補訂書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的(de)前一(yi)日(ri)(ri)。
