超過1個月未簽合同單位需承擔什么責任?

我(wo)入職新單位(wei)三個月,多次提出(chu)要簽(qian)訂勞動合同,但人(ren)事都表示再(zai)等等,請問超過一個月未簽(qian)合同,單位(wei)需承(cheng)擔(dan)什(shen)么(me)責任?

答(da) 根據《中(zhong)華人(ren)(ren)民共和國勞(lao)動(dong)(dong)(dong)合(he)(he)同法實施條例》:用人(ren)(ren)單位自用工(gong)之日起超過(guo)一(yi)個月不(bu)滿一(yi)年未(wei)與勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立書面(mian)(mian)勞(lao)動(dong)(dong)(dong)合(he)(he)同的,應當向勞(lao)動(dong)(dong)(dong)者(zhe)每(mei)月支付(fu)二倍的工(gong)資,并與勞(lao)動(dong)(dong)(dong)者(zhe)補(bu)訂(ding)書面(mian)(mian)勞(lao)動(dong)(dong)(dong)合(he)(he)同。用人(ren)(ren)單位向勞(lao)動(dong)(dong)(dong)者(zhe)每(mei)月支付(fu)兩倍工(gong)資的起算時間為用工(gong)之日起滿一(yi)個月的次日,截止時間為補(bu)訂(ding)書面(mian)(mian)勞(lao)動(dong)(dong)(dong)合(he)(he)同的前一(yi)日。
