協商解除勞動合同能獲得經濟補償嗎?

我的勞動(dong)(dong)合(he)同馬上就要到期了,請(qing)問(wen)協(xie)商(shang)解除勞動(dong)(dong)合(he)同,勞動(dong)(dong)者能(neng)獲得經濟補償(chang)嗎?

雙方(fang)(fang)協商(shang)(shang)(shang)一致(zhi)解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合(he)同,勞(lao)(lao)動(dong)(dong)(dong)者(zhe)能(neng)否獲得(de)經(jing)濟(ji)補(bu)(bu)(bu)償的(de)關鍵在于(yu)誰是提出(chu)方(fang)(fang)。《勞(lao)(lao)動(dong)(dong)(dong)合(he)同法(fa)》第46條明確,用人單位依照(zhao)本法(fa)第36條規定向勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提出(chu)解(jie)除并與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)協商(shang)(shang)(shang)一致(zhi)的(de),應(ying)向其支付經(jing)濟(ji)補(bu)(bu)(bu)償金。可見,若由勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提出(chu)解(jie)除且雙方(fang)(fang)協商(shang)(shang)(shang)一致(zhi)則無(wu)經(jing)濟(ji)補(bu)(bu)(bu)償。
