勞動者不想簽勞動合同怎么辦?
問 我是一家單位(wei)的(de)(de)領(ling)導,最(zui)近來(lai)的(de)(de)五個新員工,商量好的(de)(de)似的(de)(de),都不簽勞動(dong)合同,怎么辦呢?
答 如果勞(lao)(lao)(lao)(lao)動(dong)者拒絕簽(qian)訂勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同,單位(wei)(wei)(wei)應當(dang)以書(shu)(shu)(shu)(shu)面(mian)形式通(tong)知限期簽(qian)定(ding),仍(reng)不簽(qian)定(ding)的(de)(de),書(shu)(shu)(shu)(shu)面(mian)通(tong)知終(zhong)止(zhi)合(he)(he)同。自用(yong)(yong)工之日起一個月內,經(jing)用(yong)(yong)人單位(wei)(wei)(wei)書(shu)(shu)(shu)(shu)面(mian)通(tong)知后,勞(lao)(lao)(lao)(lao)動(dong)者不與用(yong)(yong)人單位(wei)(wei)(wei)訂立書(shu)(shu)(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同的(de)(de),用(yong)(yong)人單位(wei)(wei)(wei)應當(dang)書(shu)(shu)(shu)(shu)面(mian)通(tong)知勞(lao)(lao)(lao)(lao)動(dong)者終(zhong)止(zhi)勞(lao)(lao)(lao)(lao)動(dong)關系,無(wu)需向勞(lao)(lao)(lao)(lao)動(dong)者支付經(jing)濟補償,但是應當(dang)依法向勞(lao)(lao)(lao)(lao)動(dong)者支付其實際工作時間的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)報酬。
