勞動者不想簽勞動合同怎么辦?
問 我(wo)是一家單位(wei)的(de)(de)領導,最(zui)近(jin)來的(de)(de)五個新(xin)員工(gong),商量(liang)好的(de)(de)似(si)的(de)(de),都不簽(qian)勞動合同,怎(zen)么辦(ban)呢?
答 如果(guo)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)拒(ju)絕簽(qian)訂勞(lao)(lao)動(dong)(dong)合同(tong)(tong),單位(wei)應(ying)(ying)當(dang)以(yi)書面形(xing)式通(tong)知限(xian)期簽(qian)定,仍不簽(qian)定的(de)(de)(de),書面通(tong)知終(zhong)止合同(tong)(tong)。自(zi)用(yong)工(gong)之日起(qi)一個月內,經(jing)用(yong)人單位(wei)書面通(tong)知后,勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)不與用(yong)人單位(wei)訂立(li)書面勞(lao)(lao)動(dong)(dong)合同(tong)(tong)的(de)(de)(de),用(yong)人單位(wei)應(ying)(ying)當(dang)書面通(tong)知勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)終(zhong)止勞(lao)(lao)動(dong)(dong)關系,無需向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付經(jing)濟補償,但(dan)是應(ying)(ying)當(dang)依法向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付其實(shi)際工(gong)作時間(jian)的(de)(de)(de)勞(lao)(lao)動(dong)(dong)報(bao)酬。
