降薪是變更了勞動合同嗎?

勞(lao)動者到單位參加(jia)工作,雙方會簽訂勞(lao)動合同(tong),勞(lao)動關系存,那么在日(ri)后履行合同(tong)的過程中(zhong),單位對(dui)勞(lao)動者降薪的,是變更了勞(lao)動合同(tong)嗎(ma)?

《勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)法》第十七條(tiao)(tiao)規定(ding)中,已將勞(lao)(lao)(lao)動(dong)(dong)報酬(chou)列入勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)必(bi)備(bei)條(tiao)(tiao)款,用人(ren)單位(wei)(wei)應(ying)當按(an)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)約定(ding)支(zhi)付勞(lao)(lao)(lao)動(dong)(dong)者(zhe)勞(lao)(lao)(lao)動(dong)(dong)報酬(chou),如果用人(ren)單位(wei)(wei)需要(yao)調薪,就必(bi)須(xu)對勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)必(bi)備(bei)條(tiao)(tiao)款進行依法變(bian)更,否則就屬(shu)于違法變(bian)更,要(yao)支(zhi)付經濟補償。
