問 我沒有(you)和公司(si)簽訂(ding)書面勞動合同(tong),請問在辭(ci)職時(shi)需(xu)提前30天通知公司(si)嗎?
答(da) 根據《勞(lao)(lao)動(dong)(dong)合同(tong)(tong)法》規定(ding),建立勞(lao)(lao)動(dong)(dong)關系(xi),應當訂立書面(mian)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)。用人(ren)單位沒有(you)與勞(lao)(lao)動(dong)(dong)者(zhe)簽訂書面(mian)合同(tong)(tong)已經違反(fan)了勞(lao)(lao)動(dong)(dong)合同(tong)(tong)法強制規定(ding),勞(lao)(lao)動(dong)(dong)辭職時(shi)可(ke)以直(zhi)接依據《勞(lao)(lao)動(dong)(dong)合同(tong)(tong)法》第38條6款解(jie)除勞(lao)(lao)動(dong)(dong)合同(tong)(tong)無需提(ti)前30天通知用人(ren)單位。
