答(da) 《勞(lao)(lao)(lao)動(dong)(dong)法(fa)(fa)》第23條規(gui)定(ding)(ding):“勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)期滿(man)或者當事人約(yue)定(ding)(ding)的勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)終止條件(jian)出(chu)現,勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)即(ji)行終止。”通過(guo)該規(gui)定(ding)(ding)可(ke)(ke)以(yi)看(kan)出(chu),在(zai)(zai)《勞(lao)(lao)(lao)動(dong)(dong)法(fa)(fa)》調(diao)整下,勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的終止條件(jian)分為法(fa)(fa)定(ding)(ding)條件(jian)和(he)約(yue)定(ding)(ding)條件(jian),即(ji)用人單位可(ke)(ke)以(yi)和(he)勞(lao)(lao)(lao)動(dong)(dong)者在(zai)(zai)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)中約(yue)定(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的終止條件(jian)。只要約(yue)定(ding)(ding)的終止條件(jian)不(bu)違背法(fa)(fa)律、法(fa)(fa)規(gui)的規(gui)定(ding)(ding),該約(yue)定(ding)(ding)就(jiu)有效,就(jiu)可(ke)(ke)以(yi)依據(ju)約(yue)定(ding)(ding)來終止雙方的勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)。
