答 《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》第23條(tiao)(tiao)規(gui)定(ding)(ding)(ding)(ding):“勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)期滿或(huo)者(zhe)當事人(ren)(ren)約(yue)定(ding)(ding)(ding)(ding)的勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)終(zhong)止條(tiao)(tiao)件(jian)出現,勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)即行終(zhong)止。”通過(guo)該規(gui)定(ding)(ding)(ding)(ding)可(ke)以(yi)看出,在《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》調(diao)整下(xia),勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的終(zhong)止條(tiao)(tiao)件(jian)分(fen)為法定(ding)(ding)(ding)(ding)條(tiao)(tiao)件(jian)和(he)約(yue)定(ding)(ding)(ding)(ding)條(tiao)(tiao)件(jian),即用人(ren)(ren)單位可(ke)以(yi)和(he)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)中約(yue)定(ding)(ding)(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的終(zhong)止條(tiao)(tiao)件(jian)。只(zhi)要約(yue)定(ding)(ding)(ding)(ding)的終(zhong)止條(tiao)(tiao)件(jian)不(bu)違背法律、法規(gui)的規(gui)定(ding)(ding)(ding)(ding),該約(yue)定(ding)(ding)(ding)(ding)就(jiu)有效,就(jiu)可(ke)以(yi)依據約(yue)定(ding)(ding)(ding)(ding)來終(zhong)止雙方的勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。
