勞動合同終止理由有哪些?

答 《勞動(dong)法(fa)(fa)》第23條(tiao)(tiao)規定(ding)(ding)(ding)(ding)(ding)(ding):“勞動(dong)合(he)同(tong)期滿(man)或者當事人(ren)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)勞動(dong)合(he)同(tong)終(zhong)止條(tiao)(tiao)件(jian)(jian)(jian)(jian)出(chu)(chu)現(xian),勞動(dong)合(he)同(tong)即(ji)行終(zhong)止。”通過該規定(ding)(ding)(ding)(ding)(ding)(ding)可以看出(chu)(chu),在《勞動(dong)法(fa)(fa)》調(diao)整下,勞動(dong)合(he)同(tong)的(de)終(zhong)止條(tiao)(tiao)件(jian)(jian)(jian)(jian)分為法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)(ding)條(tiao)(tiao)件(jian)(jian)(jian)(jian)和約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)條(tiao)(tiao)件(jian)(jian)(jian)(jian),即(ji)用人(ren)單位(wei)可以和勞動(dong)者在勞動(dong)合(he)同(tong)中約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)勞動(dong)合(he)同(tong)的(de)終(zhong)止條(tiao)(tiao)件(jian)(jian)(jian)(jian)。只(zhi)要約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)終(zhong)止條(tiao)(tiao)件(jian)(jian)(jian)(jian)不違背(bei)法(fa)(fa)律、法(fa)(fa)規的(de)規定(ding)(ding)(ding)(ding)(ding)(ding),該約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)就(jiu)有效,就(jiu)可以依據約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)(ding)(ding)來終(zhong)止雙方的(de)勞動(dong)合(he)同(tong)。
