勞動合同應在何時簽訂?

問(wen) 我在單(dan)位工作了快一(yi)年(nian)了,單(dan)位雖然幫我繳(jiao)納社保(bao),但是一(yi)直沒(mei)有簽訂勞動合同。請(qing)問這種情況單(dan)位違法嗎?

根(gen)據《勞(lao)動(dong)(dong)合(he)同(tong)(tong)法》規定,已經存在事(shi)實勞(lao)動(dong)(dong)關系、用(yong)人單位未與勞(lao)動(dong)(dong)者(zhe)簽訂(ding)或續訂(ding)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的,用(yong)人單位自用(yong)工之日起超(chao)過一個(ge)月不滿一年(nian)沒有和勞(lao)動(dong)(dong)者(zhe)簽訂(ding)書(shu)面勞(lao)動(dong)(dong)合(he)同(tong)(tong),應(ying)當向勞(lao)動(dong)(dong)者(zhe)每月支(zhi)付(fu)兩倍(bei)的工資。
