答 勞(lao)動(dong)(dong)者(zhe)解(jie)除勞(lao)動(dong)(dong)合同(tong),應當提(ti)前三(san)(san)十(shi)日以(yi)書(shu)面形式通知(zhi)用(yong)人單(dan)位。超過三(san)(san)十(shi)日,勞(lao)動(dong)(dong)者(zhe)可(ke)以(yi)向用(yong)人單(dan)位提(ti)出辦理解(jie)除勞(lao)動(dong)(dong)合同(tong)手續,用(yong)人單(dan)位應予以(yi)辦理。如(ru)果勞(lao)動(dong)(dong)者(zhe)違(wei)(wei)法(fa)解(jie)除勞(lao)動(dong)(dong)合同(tong)給原用(yong)人單(dan)位造成(cheng)經濟損失,應當承擔賠(pei)償責任。如(ru)勞(lao)動(dong)(dong)者(zhe)違(wei)(wei)反提(ti)前三(san)(san)十(shi)日的(de)規定而要求解(jie)除勞(lao)動(dong)(dong)合同(tong),用(yong)人單(dan)位可(ke)不予辦理。
