我(wo)是(shi)個職(zhi)場新(xin)人,現在(zai)想了解一下(xia),請問員(yuan)工要求解除(chu)勞動合(he)同應履行哪些程(cheng)序?

勞(lao)(lao)動(dong)(dong)(dong)者(zhe)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),應當提前三(san)(san)十日以(yi)書面形式通(tong)知(zhi)用(yong)人(ren)單(dan)位(wei)。超過三(san)(san)十日,勞(lao)(lao)動(dong)(dong)(dong)者(zhe)可(ke)以(yi)向(xiang)用(yong)人(ren)單(dan)位(wei)提出(chu)辦(ban)理解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)手(shou)續,用(yong)人(ren)單(dan)位(wei)應予以(yi)辦(ban)理。如果(guo)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)違(wei)法解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)給原(yuan)用(yong)人(ren)單(dan)位(wei)造成經濟損失,應當承擔賠償責任(ren)。如勞(lao)(lao)動(dong)(dong)(dong)者(zhe)違(wei)反提前三(san)(san)十日的規定(ding)而要(yao)求解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),用(yong)人(ren)單(dan)位(wei)可(ke)不予辦(ban)理。
