降薪了是變更了勞動合同嗎?

問(wen) 勞(lao)動者到單(dan)位參加工作,雙方會(hui)簽訂勞(lao)動合同(tong),就(jiu)存在勞(lao)動關系,那么在日(ri)后(hou)履行合同(tong)的(de)過(guo)程中,單(dan)位對勞(lao)動者降(jiang)薪的(de),是(shi)變更了勞(lao)動合同(tong)嗎?
答(da) 《勞(lao)(lao)動(dong)合同(tong)(tong)法(fa)》第十七(qi)條(tiao)規定中(zhong),已將勞(lao)(lao)動(dong)報酬列入勞(lao)(lao)動(dong)合同(tong)(tong)必(bi)備條(tiao)款(kuan),用人(ren)(ren)單位(wei)應(ying)當按勞(lao)(lao)動(dong)合同(tong)(tong)約(yue)定支付勞(lao)(lao)動(dong)者(zhe)勞(lao)(lao)動(dong)報酬,如(ru)果(guo)用人(ren)(ren)單位(wei)需要(yao)(yao)調(diao)薪,就必(bi)須對勞(lao)(lao)動(dong)合同(tong)(tong)必(bi)備條(tiao)款(kuan)進行依法(fa)變更(geng),否(fou)則就屬于違(wei)法(fa)變更(geng),要(yao)(yao)支付經濟(ji)補償。
