降薪了是變更了勞動合同嗎?

問 勞(lao)(lao)(lao)動(dong)者(zhe)到單(dan)位參加工作,雙方會簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)合同,就存(cun)在(zai)勞(lao)(lao)(lao)動(dong)關系,那么在(zai)日后(hou)履行合同的過程中(zhong),單(dan)位對(dui)勞(lao)(lao)(lao)動(dong)者(zhe)降薪(xin)的,是變更了勞(lao)(lao)(lao)動(dong)合同嗎?
答(da) 《勞(lao)動(dong)(dong)合同(tong)法》第(di)十七條規定中,已將勞(lao)動(dong)(dong)報酬列(lie)入勞(lao)動(dong)(dong)合同(tong)必(bi)(bi)備(bei)條款,用人單位應當(dang)按勞(lao)動(dong)(dong)合同(tong)約定支付(fu)勞(lao)動(dong)(dong)者勞(lao)動(dong)(dong)報酬,如果用人單位需(xu)要調薪,就必(bi)(bi)須對勞(lao)動(dong)(dong)合同(tong)必(bi)(bi)備(bei)條款進(jin)行(xing)依法變(bian)更,否則就屬于違法變(bian)更,要支付(fu)經濟(ji)補償。
