續訂勞動合同需要走怎樣的程序?

首先勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期限屆滿或其(qi)他(ta)的(de)法定、約定終止條(tiao)件出現,任何一方(fang)要(yao)求續(xu)(xu)訂(ding)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong),應(ying)當(dang)提前(qian)30日向(xiang)對方(fang)發出《續(xu)(xu)訂(ding)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)通知書》,并及(ji)時與(yu)對方(fang)進行(xing)協(xie)(xie)(xie)商,依(yi)法續(xu)(xu)訂(ding)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)。其(qi)次續(xu)(xu)訂(ding)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong),如原勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)主(zhu)要(yao)條(tiao)款已有較大改變,雙方(fang)應(ying)重新(xin)(xin)協(xie)(xie)(xie)商簽訂(ding)新(xin)(xin)的(de)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong);如原勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)條(tiao)款變動(dong)(dong)(dong)不(bu)大,雙方(fang)可以簽訂(ding)《延(yan)續(xu)(xu)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)協(xie)(xie)(xie)議書》,并明(ming)確勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)延(yan)續(xu)(xu)的(de)期限及(ji)其(qi)他(ta)需重新(xin)(xin)確定的(de)合(he)(he)同(tong)(tong)條(tiao)款。最后(hou)續(xu)(xu)訂(ding)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)后(hou),用人單位應(ying)將雙方(fang)重新(xin)(xin)簽訂(ding)的(de)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)或《延(yan)續(xu)(xu)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)協(xie)(xie)(xie)議書》(附原勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong))一式兩份(fen),送有管轄權的(de)勞動(dong)(dong)(dong)鑒證機構(gou)進行(xing)鑒證,并到社會保(bao)(bao)險(xian)經辦機構(gou)辦理社會保(bao)(bao)險(xian)延(yan)續(xu)(xu)手續(xu)(xu)。
