勞動者違反勞動合同法需要承擔哪些責任?
問 在正式到工作崗位(wei)前,勞(lao)動(dong)者(zhe)需與用(yong)人(ren)單位(wei)簽訂勞(lao)動(dong)合(he)同(tong),但在某些情況下也會出(chu)現違約行為,那么(me)勞(lao)動(dong)者(zhe)違反勞(lao)動(dong)合(he)同(tong)法(fa)需要(yao)承擔(dan)哪些責任?
答(da) 首先(xian)勞(lao)(lao)動(dong)(dong)者必(bi)須承擔(dan)(dan)用(yong)(yong)人(ren)單(dan)位(wei)招收錄用(yong)(yong)其(qi)(qi)所支(zhi)付(fu)(fu)的費用(yong)(yong),動(dong)(dong)者必(bi)須承擔(dan)(dan)用(yong)(yong)人(ren)單(dan)位(wei)為其(qi)(qi)支(zhi)付(fu)(fu)的培(pei)訓費用(yong)(yong)。雙方另有約定按約定辦理。其(qi)(qi)次對用(yong)(yong)人(ren)單(dan)位(wei)的生(sheng)產、經(jing)營(ying)和工作(zuo)造成直接經(jing)濟損失(shi)的,勞(lao)(lao)動(dong)(dong)者必(bi)須承擔(dan)(dan)賠(pei)償(chang)責任。最后勞(lao)(lao)動(dong)(dong)者違反(fan)勞(lao)(lao)動(dong)(dong)合同(tong)中(zhong)約定的保密(mi)事項,給用(yong)(yong)人(ren)單(dan)位(wei)造成經(jing)濟損失(shi)的,按《反(fan)不正(zheng)當競爭法》第20條的規定向(xiang)用(yong)(yong)人(ren)單(dan)位(wei)支(zhi)付(fu)(fu)賠(pei)償(chang)費用(yong)(yong),用(yong)(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)(lao)動(dong)(dong)者在勞(lao)(lao)動(dong)(dong)合同(tong)中(zhong)約定的其(qi)(qi)他賠(pei)償(chang)費用(yong)(yong)。
