問 我(wo)是個職(zhi)場新人,現在想咨詢一下,請問單(dan)位違法解(jie)除合同(tong)該怎么(me)維護自(zi)己的權益?
答 用人單(dan)(dan)位應當(dang)在解除或終止勞動(dong)(dong)合(he)同(tong)時(shi)出具解除或終止勞動(dong)(dong)合(he)同(tong)的證(zheng)明。該(gai)法第89條也規定:用人單(dan)(dan)位違反本法規定未(wei)向勞動(dong)(dong)者(zhe)出具解除或者(zhe)終止勞動(dong)(dong)合(he)同(tong)的書(shu)面證(zheng)明,由勞動(dong)(dong)行(xing)政部門責令改正;給勞動(dong)(dong)者(zhe)造(zao)(zao)成(cheng)損(sun)害的,應當(dang)承(cheng)擔賠(pei)償責任。即用人單(dan)(dan)位如果沒(mei)有出具書(shu)面辭(ci)退證(zheng)明,給勞動(dong)(dong)者(zhe)造(zao)(zao)成(cheng)損(sun)失的,要(yao)承(cheng)擔賠(pei)償責任。
