“過勞死”可以被認定為工傷么?

最近在新聞(wen)上經常會看到(dao)“過(guo)勞死(si)”的員工,想(xiang)咨詢一(yi)下(xia),“過(guo)勞死(si)”可以被(bei)認定為工傷么?

工(gong)(gong)傷保險條例規定(ding)“在工(gong)(gong)作(zuo)時(shi)間和工(gong)(gong)作(zuo)崗(gang)(gang)位,突發疾病(bing)死(si)亡(wang)或者在48小時(shi)之(zhi)內經(jing)搶救無(wu)效死(si)亡(wang)的,可認定(ding)為工(gong)(gong)傷”。“過勞(lao)(lao)死(si)”就是(shi)(shi)在工(gong)(gong)作(zuo)時(shi)間和工(gong)(gong)作(zuo)崗(gang)(gang)位突發疾病(bing)死(si)亡(wang),因此“過勞(lao)(lao)死(si)”認定(ding)為工(gong)(gong)傷的關鍵(jian)在于是(shi)(shi)否在工(gong)(gong)作(zuo)時(shi)間和工(gong)(gong)作(zuo)崗(gang)(gang)位。如果能夠證明是(shi)(shi)在工(gong)(gong)作(zuo)時(shi)間、工(gong)(gong)作(zuo)崗(gang)(gang)位上發生的,則應該主張為工(gong)(gong)傷。
