答(da) 《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)法》沒有規定(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)最低年限(xian),但是該法的(de)(de)(de)第(di)(di)十(shi)四條規定(ding)(ding):“用(yong)人單(dan)(dan)位(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)協(xie)商一(yi)致,可以訂(ding)立(li)(li)無固(gu)定(ding)(ding)期(qi)(qi)限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)。有下列情(qing)形之一(yi),勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)提出或者(zhe)(zhe)(zhe)同(tong)(tong)(tong)(tong)意續訂(ding)、訂(ding)立(li)(li)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de),除勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)提出訂(ding)立(li)(li)固(gu)定(ding)(ding)期(qi)(qi)限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)外,應當訂(ding)立(li)(li)無固(gu)定(ding)(ding)期(qi)(qi)限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong):……(三)連續訂(ding)立(li)(li)二(er)次(ci)固(gu)定(ding)(ding)期(qi)(qi)限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong),且勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)沒有本(ben)法第(di)(di)三十(shi)九(jiu)條和第(di)(di)四十(shi)條第(di)(di)一(yi)項、第(di)(di)二(er)項規定(ding)(ding)的(de)(de)(de)情(qing)形,續訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)。”這(zhe)樣一(yi)來,從2008年起計算,員工與(yu)同(tong)(tong)(tong)(tong)一(yi)用(yong)人單(dan)(dan)位(wei)簽過兩(liang)次(ci)固(gu)定(ding)(ding)期(qi)(qi)限(xian)合(he)(he)同(tong)(tong)(tong)(tong)后,第(di)(di)三次(ci)就有權要(yao)求簽訂(ding)無固(gu)定(ding)(ding)期(qi)(qi)限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)。前兩(liang)次(ci)固(gu)定(ding)(ding)期(qi)(qi)限(xian)越短,第(di)(di)三次(ci)來得就越早。
