《勞動合同法》有沒有規定勞動合同的最低年限呢?

答 《勞動(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)(fa)》沒有規定勞動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de)最(zui)低年限(xian)(xian),但是該(gai)法(fa)(fa)的(de)(de)(de)第(di)(di)(di)十四條規定:“用人單(dan)位與勞動(dong)(dong)者協(xie)商一(yi)(yi)(yi)致,可以訂(ding)(ding)立無固(gu)定期(qi)(qi)限(xian)(xian)勞動(dong)(dong)合(he)同(tong)(tong)(tong)。有下(xia)列情(qing)(qing)形之一(yi)(yi)(yi),勞動(dong)(dong)者提出(chu)或者同(tong)(tong)(tong)意續訂(ding)(ding)、訂(ding)(ding)立勞動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de),除勞動(dong)(dong)者提出(chu)訂(ding)(ding)立固(gu)定期(qi)(qi)限(xian)(xian)勞動(dong)(dong)合(he)同(tong)(tong)(tong)外,應當訂(ding)(ding)立無固(gu)定期(qi)(qi)限(xian)(xian)勞動(dong)(dong)合(he)同(tong)(tong)(tong):……(三)連續訂(ding)(ding)立二次(ci)(ci)固(gu)定期(qi)(qi)限(xian)(xian)勞動(dong)(dong)合(he)同(tong)(tong)(tong),且勞動(dong)(dong)者沒有本法(fa)(fa)第(di)(di)(di)三十九條和(he)第(di)(di)(di)四十條第(di)(di)(di)一(yi)(yi)(yi)項、第(di)(di)(di)二項規定的(de)(de)(de)情(qing)(qing)形,續訂(ding)(ding)勞動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de)。”這樣一(yi)(yi)(yi)來,從(cong)2008年起計算(suan),員工與同(tong)(tong)(tong)一(yi)(yi)(yi)用人單(dan)位簽(qian)過兩次(ci)(ci)固(gu)定期(qi)(qi)限(xian)(xian)合(he)同(tong)(tong)(tong)后,第(di)(di)(di)三次(ci)(ci)就(jiu)有權(quan)要(yao)求(qiu)簽(qian)訂(ding)(ding)無固(gu)定期(qi)(qi)限(xian)(xian)勞動(dong)(dong)合(he)同(tong)(tong)(tong)。前兩次(ci)(ci)固(gu)定期(qi)(qi)限(xian)(xian)越短,第(di)(di)(di)三次(ci)(ci)來得就(jiu)越早。
