答 出于對懷孕(yun)女(nv)職(zhi)(zhi)工(gong)的(de)(de)特殊(shu)保護,法律(lv)規(gui)定,在(zai)女(nv)職(zhi)(zhi)工(gong)懷孕(yun)期(qi)間(jian),用(yong)(yong)人單(dan)位(wei)不(bu)得與其解(jie)除(chu)勞(lao)(lao)動合同(tong)。但(dan)是,女(nv)職(zhi)(zhi)工(gong)有下列情形之(zhi)一的(de)(de),即使(shi)是在(zai)懷孕(yun)期(qi)間(jian),用(yong)(yong)人單(dan)位(wei)也可以與之(zhi)解(jie)除(chu)勞(lao)(lao)動合同(tong):(1)在(zai)試用(yong)(yong)期(qi)間(jian)被(bei)證明不(bu)符(fu)合錄用(yong)(yong)條件的(de)(de);(2)嚴重(zhong)違反勞(lao)(lao)動紀律(lv)或(huo)者(zhe)用(yong)(yong)人單(dan)位(wei)規(gui)章制度的(de)(de);(3)嚴重(zhong)失職(zhi)(zhi),營私舞弊,對用(yong)(yong)人單(dan)位(wei)利益(yi)造成(cheng)重(zhong)大(da)損害(hai)的(de)(de);(4)被(bei)依法追究刑事責任的(de)(de)。
