過勞死算不算工傷啊?
問 我們公司最近有(you)一(yi)名員工猝死了,想(xiang)咨(zi)詢(xun)一(yi)下,過勞死算不算工傷啊?
答 工(gong)(gong)(gong)傷保(bao)險條例規定“在(zai)(zai)工(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間(jian)和工(gong)(gong)(gong)作(zuo)(zuo)崗位,突發疾(ji)病(bing)死(si)亡或者在(zai)(zai)48小(xiao)時(shi)(shi)之內經搶救無效(xiao)死(si)亡的,可(ke)認定為工(gong)(gong)(gong)傷”。“過勞死(si)”就是(shi)在(zai)(zai)工(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間(jian)和工(gong)(gong)(gong)作(zuo)(zuo)崗位突發疾(ji)病(bing)死(si)亡,因(yin)此“過勞死(si)”認定為工(gong)(gong)(gong)傷的關鍵在(zai)(zai)于是(shi)否在(zai)(zai)工(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間(jian)和工(gong)(gong)(gong)作(zuo)(zuo)崗位。如果能夠證明是(shi)在(zai)(zai)工(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間(jian)、工(gong)(gong)(gong)作(zuo)(zuo)崗位上發生的,則應該主(zhu)張為工(gong)(gong)(gong)傷。
