試用期不合格能否延長試用期?

答 《勞(lao)(lao)動(dong)(dong)合同(tong)法》第十九條規定了試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)(de)上(shang)(shang)(shang)限(xian)(xian),即勞(lao)(lao)動(dong)(dong)合同(tong)期(qi)(qi)限(xian)(xian)三(san)個(ge)月(yue)以(yi)上(shang)(shang)(shang)不(bu)(bu)滿一年(nian)的(de)(de)(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)超過(guo)一個(ge)月(yue);勞(lao)(lao)動(dong)(dong)合同(tong)期(qi)(qi)限(xian)(xian)一年(nian)以(yi)上(shang)(shang)(shang)不(bu)(bu)滿三(san)年(nian)的(de)(de)(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)超過(guo)二個(ge)月(yue);三(san)年(nian)以(yi)上(shang)(shang)(shang)固(gu)(gu)定期(qi)(qi)限(xian)(xian)和(he)無固(gu)(gu)定期(qi)(qi)限(xian)(xian)的(de)(de)(de)勞(lao)(lao)動(dong)(dong)合同(tong),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)超過(guo)六個(ge)月(yue)。 如果(guo)勞(lao)(lao)動(dong)(dong)者在試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)內達不(bu)(bu)到用(yong)(yong)(yong)(yong)人單位(wei)(wei)的(de)(de)(de)要求,用(yong)(yong)(yong)(yong)人單位(wei)(wei)可(ke)根據(ju)勞(lao)(lao)動(dong)(dong)合同(tong)法第三(san)十九條之規定以(yi)勞(lao)(lao)動(dong)(dong)者在試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)間(jian)被證明不(bu)(bu)符合錄用(yong)(yong)(yong)(yong)條件(jian)為由解除勞(lao)(lao)動(dong)(dong)合同(tong),但不(bu)(bu)得(de)延(yan)長試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi),用(yong)(yong)(yong)(yong)人單位(wei)(wei)延(yan)長試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)(de),屬于違(wei)法約定試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi),需(xu)承擔相(xiang)應的(de)(de)(de)法律后果(guo)。
