上班一個月后簽合同違法么?

答 單(dan)位在(zai)(zai)建立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)之日(ri)起(qi)(qi)(qi)最遲應(ying)在(zai)(zai)“一個月(yue)”內訂(ding)立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)。因此,這實(shi)際上是有(you)限度地放(fang)寬了(le)訂(ding)立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)(de)時間(jian)要求,規定已建立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi),未(wei)(wei)同(tong)(tong)(tong)時訂(ding)立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)(de),如果在(zai)(zai)自(zi)用(yong)(yong)工(gong)之日(ri)起(qi)(qi)(qi)一個月(yue)內訂(ding)立了(le)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),其行為即(ji)不違法。但如果用(yong)(yong)人單(dan)位自(zi)用(yong)(yong)工(gong)之日(ri)起(qi)(qi)(qi)超過一個月(yue)不滿一年未(wei)(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者訂(ding)立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)(de),則應(ying)當向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者每月(yue)支(zhi)付兩倍的(de)(de)工(gong)資(zi)(《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)法》第82條)。這是對用(yong)(yong)人單(dan)位在(zai)(zai)自(zi)用(yong)(yong)工(gong)之日(ri)一個月(yue)內未(wei)(wei)訂(ding)立書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)(de)處(chu)罰措施。
