答 單(dan)位(wei)在建(jian)立勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi)之(zhi)(zhi)日起最(zui)遲應(ying)在“一個(ge)(ge)月”內(nei)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)。因此,這實際上是有(you)限度地放寬了(le)訂立勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de)時間要求,規定已建(jian)立勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi),未(wei)同(tong)(tong)(tong)時訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de),如(ru)果在自(zi)(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日起一個(ge)(ge)月內(nei)訂立了(le)書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong),其行(xing)為即不違法(fa)。但如(ru)果用(yong)人單(dan)位(wei)自(zi)(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日起超(chao)過(guo)一個(ge)(ge)月不滿一年未(wei)與勞(lao)(lao)(lao)(lao)動(dong)者(zhe)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de),則應(ying)當向勞(lao)(lao)(lao)(lao)動(dong)者(zhe)每月支付兩倍的(de)(de)(de)工(gong)(gong)資(zi)(《勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)法(fa)》第82條)。這是對用(yong)人單(dan)位(wei)在自(zi)(zi)用(yong)工(gong)(gong)之(zhi)(zhi)日一個(ge)(ge)月內(nei)未(wei)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de)處罰措(cuo)施(shi)。
