答(da) 單(dan)位在(zai)建(jian)立(li)勞動(dong)(dong)(dong)關(guan)系之(zhi)日起(qi)最遲應在(zai)“一(yi)個(ge)月”內(nei)訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)。因此,這實際上是(shi)有限度地(di)放寬了訂(ding)立(li)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的(de)時間要求,規定已(yi)建(jian)立(li)勞動(dong)(dong)(dong)關(guan)系,未同(tong)(tong)(tong)時訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的(de),如果在(zai)自用(yong)(yong)工之(zhi)日起(qi)一(yi)個(ge)月內(nei)訂(ding)立(li)了書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong),其(qi)行為(wei)即不(bu)違(wei)法。但(dan)如果用(yong)(yong)人(ren)單(dan)位自用(yong)(yong)工之(zhi)日起(qi)超(chao)過一(yi)個(ge)月不(bu)滿(man)一(yi)年(nian)未與(yu)勞動(dong)(dong)(dong)者訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的(de),則應當向(xiang)勞動(dong)(dong)(dong)者每月支付(fu)兩倍的(de)工資(《勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法》第82條)。這是(shi)對用(yong)(yong)人(ren)單(dan)位在(zai)自用(yong)(yong)工之(zhi)日一(yi)個(ge)月內(nei)未訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的(de)處罰措施(shi)。
