上班一個月后簽合同違法么?

我來公(gong)司的時候,公(gong)司說一個(ge)月(yue)后(hou)簽合(he)同,請(qing)問,上(shang)班(ban)一個(ge)月(yue)后(hou)簽合(he)同違(wei)法(fa)么?

單位(wei)在(zai)建立(li)勞(lao)動(dong)(dong)關(guan)系(xi)之(zhi)日(ri)起(qi)最遲(chi)應在(zai)“一(yi)(yi)個(ge)月(yue)”內訂(ding)(ding)(ding)立(li)書(shu)面(mian)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。因此,這實(shi)際上(shang)是(shi)有限度地放寬了訂(ding)(ding)(ding)立(li)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)時(shi)間要求,規定已建立(li)勞(lao)動(dong)(dong)關(guan)系(xi),未同(tong)(tong)時(shi)訂(ding)(ding)(ding)立(li)書(shu)面(mian)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de),如果(guo)在(zai)自用工(gong)之(zhi)日(ri)起(qi)一(yi)(yi)個(ge)月(yue)內訂(ding)(ding)(ding)立(li)了書(shu)面(mian)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong),其行為即不違法。但如果(guo)用人(ren)單位(wei)自用工(gong)之(zhi)日(ri)起(qi)超(chao)過(guo)一(yi)(yi)個(ge)月(yue)不滿一(yi)(yi)年未與勞(lao)動(dong)(dong)者訂(ding)(ding)(ding)立(li)書(shu)面(mian)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de),則應當向(xiang)勞(lao)動(dong)(dong)者每月(yue)支付兩倍的(de)工(gong)資(《勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法》第82條)。這是(shi)對用人(ren)單位(wei)在(zai)自用工(gong)之(zhi)日(ri)一(yi)(yi)個(ge)月(yue)內未訂(ding)(ding)(ding)立(li)書(shu)面(mian)勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)處罰(fa)措施(shi)。
