答(da) 職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)有下列情形之一(yi)的(de)(de),應當認(ren)定(ding)為(wei)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷: (一(yi))在(zai)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)時(shi)間(jian)和(he)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)場(chang)(chang)所內(nei),因(yin)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)原因(yin)受(shou)到(dao)(dao)(dao)事故(gu)傷害的(de)(de); (二)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)時(shi)間(jian)前后在(zai)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)場(chang)(chang)所內(nei),從事與工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)有關的(de)(de)預備性(xing)或(huo)(huo)者(zhe)收(shou)尾性(xing)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)受(shou)到(dao)(dao)(dao)事故(gu)傷害的(de)(de); (三)在(zai)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)時(shi)間(jian)和(he)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)場(chang)(chang)所內(nei),因(yin)履行(xing)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)職(zhi)(zhi)責受(shou)到(dao)(dao)(dao)暴力等意外傷害的(de)(de); (四)患職(zhi)(zhi)業病的(de)(de); (五(wu))因(yin)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)外出期(qi)間(jian),由(you)于工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)原因(yin)受(shou)到(dao)(dao)(dao)傷害或(huo)(huo)者(zhe)發生事故(gu)下落不明的(de)(de); (六)在(zai)上下班(ban)途中,受(shou)到(dao)(dao)(dao)機動車事故(gu)傷害的(de)(de); (七)法(fa)律、行(xing)政法(fa)規(gui)規(gui)定(ding)應當認(ren)定(ding)為(wei)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷的(de)(de)其他(ta)情形。
