公司在哪些情況下解除合同需要支付違約金啊?

答 《勞(lao)(lao)動合(he)同(tong)(tong)法》第40條規(gui)定:在(zai)以(yi)下三種情形下,用(yong)人(ren)單(dan)位(wei)向勞(lao)(lao)動者(zhe)提出(chu)解除勞(lao)(lao)動合(he)同(tong)(tong)時,應支付(fu)經(jing)(jing)濟補償金(jin):(1)勞(lao)(lao)動者(zhe)患(huan)病或(huo)者(zhe)非(fei)因(yin)工(gong)(gong)負傷,在(zai)規(gui)定的(de)(de)醫療期滿后不(bu)能從(cong)事原工(gong)(gong)作(zuo)(zuo),也(ye)不(bu)能從(cong)事由用(yong)人(ren)單(dan)位(wei)另行安排的(de)(de)工(gong)(gong)作(zuo)(zuo)的(de)(de);(2)勞(lao)(lao)動者(zhe)不(bu)能勝(sheng)任工(gong)(gong)作(zuo)(zuo),經(jing)(jing)過培訓(xun)或(huo)者(zhe)調(diao)整工(gong)(gong)作(zuo)(zuo)崗位(wei),仍不(bu)能勝(sheng)任工(gong)(gong)作(zuo)(zuo)的(de)(de);(3)勞(lao)(lao)動合(he)同(tong)(tong)訂(ding)立時所依據的(de)(de)客觀情況發生重大(da)變化,致使勞(lao)(lao)動合(he)同(tong)(tong)無法履行,經(jing)(jing)用(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)(lao)動者(zhe)協商(shang),未能就變更勞(lao)(lao)動合(he)同(tong)(tong)內容達成協議的(de)(de)。
