用人單位發生合并或者分立等情況,勞動合同怎么辦?

最近我們(men)公司單位發生合(he)并或者分(fen)立等(deng)情(qing)況,請問,勞(lao)動合(he)同怎么辦?

答(da) 我國勞(lao)動(dong)合(he)(he)同(tong)(tong)(tong)法明確規定:“用(yong)人單(dan)(dan)位(wei)(wei)發生(sheng)合(he)(he)并(bing)(bing)或者(zhe)分立(li)等情(qing)況,原(yuan)勞(lao)動(dong)合(he)(he)同(tong)(tong)(tong)繼續有(you)效,勞(lao)動(dong)合(he)(he)同(tong)(tong)(tong)由承繼其(qi)權利和(he)義務的用(yong)人單(dan)(dan)位(wei)(wei)繼續履(lv)行(xing)。”因此,勞(lao)動(dong)合(he)(he)同(tong)(tong)(tong)簽訂后,用(yong)人單(dan)(dan)位(wei)(wei)發生(sheng)合(he)(he)并(bing)(bing)、分立(li)并(bing)(bing)不影響(xiang)勞(lao)動(dong)合(he)(he)同(tong)(tong)(tong)的履(lv)行(xing)。
