答 根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)》第(di)19條(tiao)(tiao)的(de)規(gui)(gui)定:“試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)包含在(zai)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)限(xian)內。”其實(shi),用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)在(zai)事實(shi)上雇用(yong)(yong)(yong)(yong)員(yuan)工(gong)時(shi)就(jiu)產生(sheng)勞(lao)(lao)(lao)動(dong)(dong)(dong)關系,就(jiu)應當(dang)與試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)內的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)者訂立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong),并按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)的(de)規(gui)(gui)定約定試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)的(de)期(qi)限(xian)。 如果用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)違法(fa)約定試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)期(qi)限(xian)規(gui)(gui)定的(de),那(nei)么應當(dang)按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)第(di)83條(tiao)(tiao)的(de)規(gui)(gui)定承(cheng)擔法(fa)律責任:即用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)違法(fa)約定試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)的(de),由勞(lao)(lao)(lao)動(dong)(dong)(dong)行政部門(men)責令改正;違法(fa)約定的(de)試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)已(yi)經(jing)履(lv)行的(de),由用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)以勞(lao)(lao)(lao)動(dong)(dong)(dong)者試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)滿月工(gong)資為標(biao)準,按已(yi)經(jing)履(lv)行的(de)超過(guo)法(fa)定期(qi)限(xian)的(de)期(qi)間向(xiang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者支付(fu)賠償(chang)金。如果沒有(you)訂立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong),也要依據勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)和實(shi)施條(tiao)(tiao)例的(de)規(gui)(gui)定來辦理(li)。
