答 根據(ju)《勞動(dong)(dong)合同(tong)法(fa)》第4條規定(ding): 用(yong)人單位應當(dang)依(yi)法(fa)建(jian)立和完善勞動(dong)(dong)規章(zhang)制(zhi)(zhi)度,保障勞動(dong)(dong)者享有勞動(dong)(dong)權利、履行勞動(dong)(dong)義(yi)務(wu)。另外用(yong)人單位制(zhi)(zhi)定(ding)的內(nei)部(bu)規章(zhang)制(zhi)(zhi)度與(yu)集體(ti)合同(tong)或者勞動(dong)(dong)合同(tong)約定(ding)的內(nei)容(rong)不一致(zhi),勞動(dong)(dong)者請求優(you)先適用(yong)合同(tong)約定(ding)的。
