答 根據《勞(lao)動合同法》第八(ba)十三條(tiao)規(gui)定(ding):“用(yong)(yong)人(ren)單(dan)位(wei)違反本法規(gui)定(ding)與勞(lao)動者(zhe)(zhe)約(yue)定(ding)試(shi)用(yong)(yong)期(qi)(qi)(qi)的,由(you)勞(lao)動行政部門責令改正(zheng);違法約(yue)定(ding)的試(shi)用(yong)(yong)期(qi)(qi)(qi)已經履(lv)行的,由(you)用(yong)(yong)人(ren)單(dan)位(wei)以勞(lao)動者(zhe)(zhe)試(shi)用(yong)(yong)期(qi)(qi)(qi)滿月工資為標準,按已經履(lv)行的超過(guo)法定(ding)試(shi)用(yong)(yong)期(qi)(qi)(qi)的期(qi)(qi)(qi)間向(xiang)勞(lao)動者(zhe)(zhe)支付賠償金。”
