答 按照《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同法》的(de)(de)有關(guan)規定,在試(shi)用(yong)期(qi)內,只有當勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)具有下述法定情(qing)(qing)形之一時(shi),用(yong)人(ren)(ren)單位(wei)(wei)(wei)才可以(yi)辭(ci)退(tui)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe): (1)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)在試(shi)用(yong)期(qi)間被證明不符合錄用(yong)條件的(de)(de); (2)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)嚴(yan)重(zhong)違反用(yong)人(ren)(ren)單位(wei)(wei)(wei)規章制度的(de)(de); (3)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)嚴(yan)重(zhong)失職,營私舞弊,給用(yong)人(ren)(ren)單位(wei)(wei)(wei)造(zao)成重(zhong)大損害的(de)(de); (4)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)同時(shi)與其他用(yong)人(ren)(ren)單位(wei)(wei)(wei)建(jian)立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系,對完成本單位(wei)(wei)(wei)的(de)(de)工(gong)(gong)作(zuo)(zuo)任(ren)務造(zao)成嚴(yan)重(zhong)影響,或者(zhe)經用(yong)人(ren)(ren)單位(wei)(wei)(wei)提出(chu),拒不改正的(de)(de); (5)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)以(yi)欺詐(zha)、脅迫的(de)(de)手段或者(zhe)乘人(ren)(ren)之危(wei),使用(yong)人(ren)(ren)單位(wei)(wei)(wei)在違背真實(shi)意思的(de)(de)情(qing)(qing)況下訂立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同的(de)(de); (6)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)被依(yi)法追究刑事(shi)責任(ren)的(de)(de); (7)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)患病(bing)或者(zhe)非因(yin)工(gong)(gong)負傷,在規定的(de)(de)醫療期(qi)滿后不能從(cong)事(shi)原工(gong)(gong)作(zuo)(zuo),也不能從(cong)事(shi)由用(yong)人(ren)(ren)單位(wei)(wei)(wei)另(ling)行安(an)排工(gong)(gong)作(zuo)(zuo)的(de)(de); (8)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)不能勝任(ren)工(gong)(gong)作(zuo)(zuo),經過(guo)培訓或者(zhe)調整工(gong)(gong)作(zuo)(zuo)崗位(wei)(wei)(wei),仍不能勝任(ren)工(gong)(gong)作(zuo)(zuo)的(de)(de)。除上述情(qing)(qing)形外,用(yong)人(ren)(ren)單位(wei)(wei)(wei)不得在試(shi)用(yong)期(qi)內解除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同。
