問 我進入公司(si)時公司(si)規(gui)模還比較小,沒有簽訂勞動(dong)合(he)同,想(xiang)咨(zi)詢(xun)一(yi)下,請問未(wei)簽勞動(dong)合(he)同能隨時離(li)職嗎?
答 應(ying)當(dang)(dang)訂立(li)勞(lao)動(dong)(dong)(dong)合同而(er)未訂立(li)的,勞(lao)動(dong)(dong)(dong)者(zhe)可以隨(sui)時終(zhong)止(zhi)勞(lao)動(dong)(dong)(dong)關系(xi)。應(ying)當(dang)(dang)訂立(li)勞(lao)動(dong)(dong)(dong)合同而(er)未訂立(li)的,用人單位提出終(zhong)止(zhi)勞(lao)動(dong)(dong)(dong)關系(xi),應(ying)當(dang)(dang)提前(qian)三十日通知勞(lao)動(dong)(dong)(dong)者(zhe),但勞(lao)動(dong)(dong)(dong)者(zhe)具有(you)第(di)三十九條規定情形之一的,勞(lao)動(dong)(dong)(dong)關系(xi)應(ying)當(dang)(dang)順延至該(gai)情形消失(shi)。
