未簽勞動合同如何確定試用期?

用人單位未(wei)與勞(lao)動者(zhe)簽訂書面勞(lao)動合同,請問如何(he)確定勞(lao)動者(zhe)的試用期呢?

答(da) 在雙方未簽訂勞動(dong)合(he)(he)同(tong)而(er)又無其(qi)他(ta)證據(ju)證明有(you)試(shi)用(yong)期(qi)的情況下,應當(dang)認定(ding)(ding)(ding)用(yong)人單位放棄(qi)了試(shi)用(yong)期(qi),雙方勞動(dong)關(guan)系中不(bu)存在試(shi)用(yong)期(qi)問題。這就(jiu)要(yao)(yao)求用(yong)人單位通常(chang)必須在建(jian)立勞動(dong)關(guan)系時就(jiu)要(yao)(yao)訂立勞動(dong)合(he)(he)同(tong),或至少就(jiu)試(shi)用(yong)期(qi)達成約定(ding)(ding)(ding),否則此后(hou)再訂立勞動(dong)合(he)(he)同(tong)就(jiu)可能(neng)無法約定(ding)(ding)(ding)試(shi)用(yong)期(qi)。
