答 在(zai)雙方未(wei)簽訂(ding)勞動(dong)(dong)合(he)同(tong)(tong)而又(you)無(wu)其他證據證明有試(shi)用期(qi)的情況下,應當認定用人單位(wei)放棄了試(shi)用期(qi),雙方勞動(dong)(dong)關系中不(bu)存在(zai)試(shi)用期(qi)問題。這就要求用人單位(wei)通常(chang)必須在(zai)建立勞動(dong)(dong)關系時(shi)就要訂(ding)立勞動(dong)(dong)合(he)同(tong)(tong),或至少就試(shi)用期(qi)達成約定,否則此后再訂(ding)立勞動(dong)(dong)合(he)同(tong)(tong)就可能(neng)無(wu)法約定試(shi)用期(qi)。
