簽署的集體合同,出現勞動爭議怎么辦?

我(wo)來公司的時候簽(qian)署的是集體合同(tong),想(xiang)咨詢(xun)一(yi)下,出現勞動爭(zheng)議怎么辦?

在(zai)用人單位(wei)(wei)與(yu)勞動(dong)(dong)(dong)者(zhe)之間如果因集體(ti)(ti)(ti)合(he)(he)(he)同(tong)(tong)(tong)發生爭(zheng)(zheng)(zheng)議(yi),除了雙(shuang)方可以(yi)(yi)協(xie)商解(jie)決以(yi)(yi)外,也同(tong)(tong)(tong)樣(yang)可以(yi)(yi)通過勞動(dong)(dong)(dong)仲(zhong)(zhong)裁、訴(su)訟等(deng)方式(shi)解(jie)決集體(ti)(ti)(ti)合(he)(he)(he)同(tong)(tong)(tong)爭(zheng)(zheng)(zheng)議(yi)。 根據《勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法(fa)》規定,用人單位(wei)(wei)如違反集體(ti)(ti)(ti)合(he)(he)(he)同(tong)(tong)(tong),侵犯職工(gong)(gong)勞動(dong)(dong)(dong)權益,工(gong)(gong)會可以(yi)(yi)依(yi)法(fa)代表(biao)勞動(dong)(dong)(dong)者(zhe)要(yao)求用人單位(wei)(wei)承(cheng)擔(dan)責任;集體(ti)(ti)(ti)合(he)(he)(he)同(tong)(tong)(tong)爭(zheng)(zheng)(zheng)議(yi)經協(xie)商解(jie)決不(bu)(bu)成的(de),工(gong)(gong)會可以(yi)(yi)依(yi)法(fa)申請仲(zhong)(zhong)裁、提(ti)起(qi)(qi)訴(su)訟。 關于這一(yi)點,在(zai)《勞動(dong)(dong)(dong)法(fa)》中有(you)更詳細的(de)規定:“因履行集體(ti)(ti)(ti)合(he)(he)(he)同(tong)(tong)(tong)發生爭(zheng)(zheng)(zheng)議(yi),當事人協(xie)商解(jie)決不(bu)(bu)成的(de),可以(yi)(yi)向勞動(dong)(dong)(dong)爭(zheng)(zheng)(zheng)議(yi)仲(zhong)(zhong)裁委(wei)員會申請仲(zhong)(zhong)裁;對仲(zhong)(zhong)裁裁決不(bu)(bu)服的(de),可以(yi)(yi)自收(shou)到仲(zhong)(zhong)裁裁決書之日(ri)起(qi)(qi)十(shi)五日(ri)內(nei)向人民法(fa)院(yuan)提(ti)起(qi)(qi)訴(su)訟。”
