問 我是個大四的學(xue)生(sheng),最近找到(dao)實(shi)習(xi)單(dan)位了,想(xiang)咨(zi)詢一下(xia),實(shi)習(xi)工資是不是不能低(di)于(yu)最低(di)工資標(biao)準(zhun)啊?
答(da) 依據《關(guan)于(yu)貫(guan)徹執行〈中華人民共(gong)和國勞(lao)動(dong)(dong)法〉若(ruo)干問題的意見》第12條的規定:“在校(xiao)生利(li)用業(ye)余時間勤工(gong)助學,不(bu)(bu)視為就業(ye),未建(jian)立勞(lao)動(dong)(dong)關(guan)系(xi),可(ke)以(yi)不(bu)(bu)簽訂勞(lao)動(dong)(dong)合同。從事有(you)收(shou)(shou)入勞(lao)動(dong)(dong)的在校(xiao)學生,不(bu)(bu)屬(shu)于(yu)建(jian)立勞(lao)動(dong)(dong)合同關(guan)系(xi)范圍,他們(men)的實習收(shou)(shou)入可(ke)以(yi)不(bu)(bu)適用最低工(gong)資(zi)的有(you)關(guan)規定。”
