試用期期間離職是否要提前一個月申請?

答 《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)法》第(di)10條規(gui)定(ding):建(jian)立勞(lao)(lao)(lao)動(dong)(dong)關系,應當訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)合同(tong)。已(yi)建(jian)立勞(lao)(lao)(lao)動(dong)(dong)關系,未(wei)同(tong)時訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)合同(tong)的,應當自用工(gong)之日起一個月(yue)(yue)內訂(ding)(ding)立書面勞(lao)(lao)(lao)動(dong)(dong)合同(tong)。第(di)30條規(gui)定(ding):用人單位應當按照勞(lao)(lao)(lao)動(dong)(dong)合同(tong)約定(ding)和國家規(gui)定(ding),向勞(lao)(lao)(lao)動(dong)(dong)者及時足(zu)額支付勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬(chou)。由此可見,該(gai)公司不與勞(lao)(lao)(lao)動(dong)(dong)者簽訂(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)、不給勞(lao)(lao)(lao)動(dong)(dong)者繳納(na)社會保(bao)險費本身就是違法的,勞(lao)(lao)(lao)動(dong)(dong)者有權隨時辭職(zhi),無需(xu)提前(qian)一個月(yue)(yue)申請(qing)。
