答(da) 首先勞(lao)(lao)動(dong)者在該用(yong)人(ren)單(dan)(dan)位連續工(gong)(gong)作滿(man)十年(nian)的,用(yong)人(ren)單(dan)(dan)位初次實行勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)制度或者國有企業改制重(zhong)新訂立勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)時,勞(lao)(lao)動(dong)者在該用(yong)人(ren)單(dan)(dan)位連續工(gong)(gong)作滿(man)十年(nian)且(qie)距法定(ding)退休年(nian)齡不足十年(nian)的其次連續訂立二次固(gu)定(ding)期限(xian)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong),且(qie)勞(lao)(lao)動(dong)者沒有勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)法第(di)三(san)十九條和(he)第(di)四十條第(di)一(yi)項(xiang)、第(di)二項(xiang)規(gui)定(ding)的情形(xing),續訂勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的。
