答 首(shou)先勞(lao)動(dong)(dong)者在該(gai)用人(ren)單位連(lian)(lian)續(xu)(xu)工(gong)作滿(man)(man)十年(nian)的,用人(ren)單位初次實行勞(lao)動(dong)(dong)合(he)同(tong)(tong)制(zhi)(zhi)度或者國有企業(ye)改(gai)制(zhi)(zhi)重新訂立勞(lao)動(dong)(dong)合(he)同(tong)(tong)時,勞(lao)動(dong)(dong)者在該(gai)用人(ren)單位連(lian)(lian)續(xu)(xu)工(gong)作滿(man)(man)十年(nian)且(qie)距(ju)法定(ding)(ding)退(tui)休年(nian)齡不足(zu)十年(nian)的其(qi)次連(lian)(lian)續(xu)(xu)訂立二次固定(ding)(ding)期限勞(lao)動(dong)(dong)合(he)同(tong)(tong),且(qie)勞(lao)動(dong)(dong)者沒(mei)有勞(lao)動(dong)(dong)合(he)同(tong)(tong)法第(di)三十九(jiu)條(tiao)和(he)第(di)四十條(tiao)第(di)一項、第(di)二項規定(ding)(ding)的情(qing)形,續(xu)(xu)訂勞(lao)動(dong)(dong)合(he)同(tong)(tong)的。
