勞動合同自動續約的條件是什么?

答 勞(lao)動(dong)(dong)(dong)合同(tong)期(qi)滿后,勞(lao)動(dong)(dong)(dong)者仍(reng)在原(yuan)(yuan)(yuan)用(yong)人單位(wei)工作,原(yuan)(yuan)(yuan)用(yong)人單位(wei)未表示(shi)異議(yi)的,視為(wei)雙方(fang)(fang)同(tong)意以原(yuan)(yuan)(yuan)條件繼續(xu)履行(xing)(xing)勞(lao)動(dong)(dong)(dong)合同(tong)。一方(fang)(fang)提出(chu)終(zhong)止勞(lao)動(dong)(dong)(dong)關系的,人民法(fa)院應(ying)當(dang)(dang)(dang)支(zhi)持。”由此可見,如果當(dang)(dang)(dang)事人雙方(fang)(fang)在原(yuan)(yuan)(yuan)勞(lao)動(dong)(dong)(dong)合同(tong)期(qi)滿后對(dui)繼續(xu)執(zhi)行(xing)(xing)原(yuan)(yuan)(yuan)勞(lao)動(dong)(dong)(dong)合同(tong)約(yue)定(ding)的工資和福利待(dai)遇標(biao)準、勞(lao)動(dong)(dong)(dong)條件等沒有提出(chu)異議(yi),應(ying)當(dang)(dang)(dang)視為(wei)雙方(fang)(fang)默(mo)認按照原(yuan)(yuan)(yuan)勞(lao)動(dong)(dong)(dong)合同(tong)的約(yue)定(ding)的內容繼續(xu)履行(xing)(xing)。由于“一方(fang)(fang)提出(chu)終(zhong)止勞(lao)動(dong)(dong)(dong)關系的,人民法(fa)院應(ying)當(dang)(dang)(dang)支(zhi)持。”,因(yin)此,雙方(fang)(fang)默(mo)認繼續(xu)履行(xing)(xing)原(yuan)(yuan)(yuan)勞(lao)動(dong)(dong)(dong)合同(tong)約(yue)定(ding)的內容不應(ying)包括原(yuan)(yuan)(yuan)合同(tong)所(suo)約(yue)定(ding)的期(qi)限。所(suo)以勞(lao)動(dong)(dong)(dong)合同(tong)的續(xu)訂是可以默(mo)示(shi)的。
