想咨詢一(yi)下(xia),單位未按照勞(lao)(lao)動(dong)(dong)合同約定提(ti)供勞(lao)(lao)動(dong)(dong)保護或(huo)者勞(lao)(lao)動(dong)(dong)條件(jian)的(de)怎么辦?

根據《勞(lao)動(dong)合(he)同法》第(di)38條規(gui)定,單(dan)(dan)(dan)位未按(an)照勞(lao)動(dong)合(he)同約(yue)定提供(gong)(gong)勞(lao)動(dong)保(bao)護(hu)或(huo)者(zhe)(zhe)勞(lao)動(dong)條件(jian)(jian)的,勞(lao)動(dong)者(zhe)(zhe)可(ke)以解(jie)除勞(lao)動(dong)合(he)同。如果單(dan)(dan)(dan)位安(an)排勞(lao)動(dong)者(zhe)(zhe)工(gong)(gong)作(zuo)的環境和工(gong)(gong)作(zuo)條件(jian)(jian)惡劣,存在安(an)全隱(yin)患(huan)或(huo)漏洞,有可(ke)能給勞(lao)動(dong)者(zhe)(zhe)的安(an)全帶來威脅;或(huo)者(zhe)(zhe)勞(lao)動(dong)者(zhe)(zhe)的工(gong)(gong)作(zuo)環境與勞(lao)動(dong)合(he)同約(yue)定的內容不符,勞(lao)動(dong)者(zhe)(zhe)都(dou)可(ke)以以此理由提出解(jie)除勞(lao)動(dong)合(he)同。用人單(dan)(dan)(dan)位隨(sui)意強行給員工(gong)(gong)“放假”或(huo)“停(ting)工(gong)(gong)”,無疑剝(bo)奪了(le)勞(lao)動(dong)者(zhe)(zhe)的工(gong)(gong)作(zuo)權利,讓勞(lao)動(dong)者(zhe)(zhe)失去賴以工(gong)(gong)作(zuo)的基本條件(jian)(jian),因(yin)此可(ke)視為未提供(gong)(gong)勞(lao)動(dong)條件(jian)(jian)。
