試用期含在勞動合同期限內?

問(wen) 我現在是試(shi)用(yong)期(qi)員(yuan)工,想(xiang)咨(zi)詢(xun)一下,試(shi)用(yong)期(qi)含(han)在勞動合同期(qi)限(xian)內么?

根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)(fa)》第(di)(di)19條的(de)(de)規(gui)定(ding)(ding)(ding):“試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)包含在勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)(qi)限(xian)內(nei)。”其實(shi),用(yong)人(ren)(ren)單(dan)(dan)位在事實(shi)上雇用(yong)員工(gong)時就(jiu)產(chan)生勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系(xi),就(jiu)應當(dang)與(yu)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)內(nei)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者訂立書面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong),并按照(zhao)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)(fa)的(de)(de)規(gui)定(ding)(ding)(ding)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)的(de)(de)期(qi)(qi)(qi)(qi)限(xian)。  如果用(yong)人(ren)(ren)單(dan)(dan)位違(wei)法(fa)(fa)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)期(qi)(qi)(qi)(qi)限(xian)規(gui)定(ding)(ding)(ding)的(de)(de),那(nei)么應當(dang)按照(zhao)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)(fa)第(di)(di)83條的(de)(de)規(gui)定(ding)(ding)(ding)承(cheng)擔法(fa)(fa)律責任:即用(yong)人(ren)(ren)單(dan)(dan)位違(wei)法(fa)(fa)約(yue)定(ding)(ding)(ding)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)的(de)(de),由勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)行(xing)政部門責令改正(zheng);違(wei)法(fa)(fa)約(yue)定(ding)(ding)(ding)的(de)(de)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)已經(jing)履行(xing)的(de)(de),由用(yong)人(ren)(ren)單(dan)(dan)位以勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)滿月工(gong)資為標準,按已經(jing)履行(xing)的(de)(de)超過法(fa)(fa)定(ding)(ding)(ding)期(qi)(qi)(qi)(qi)限(xian)的(de)(de)期(qi)(qi)(qi)(qi)間向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者支付(fu)賠償金。如果沒(mei)有訂立書面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong),也(ye)要(yao)依據勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)(fa)和實(shi)施(shi)條例的(de)(de)規(gui)定(ding)(ding)(ding)來辦理(li)。
