可否單方延長試用期?

答 《勞(lao)動(dong)(dong)合同法(fa)》規(gui)定(ding),同一(yi)用(yong)(yong)(yong)人單位與同一(yi)勞(lao)動(dong)(dong)者只(zhi)能(neng)約定(ding)一(yi)次(ci)試用(yong)(yong)(yong)期。但是(shi),該(gai)法(fa)又(you)說雙(shuang)方(fang)協(xie)商一(yi)致(zhi)可(ke)以(yi)變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合同。所以(yi)絕對(dui)不可(ke)以(yi)延長(chang)試用(yong)(yong)(yong)期的觀點(dian),是(shi)不對(dui)的。用(yong)(yong)(yong)工雙(shuang)方(fang)可(ke)以(yi)通過(guo)協(xie)商一(yi)致(zhi)變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合同的方(fang)式變(bian)(bian)更(geng)(geng)試用(yong)(yong)(yong)期。當然(ran)延長(chang)后的試用(yong)(yong)(yong)期總共不能(neng)超過(guo)《勞(lao)動(dong)(dong)合同法(fa)》規(gui)定(ding)的上限(xian):三(san)年(nian)的勞(lao)動(dong)(dong)合同最(zui)多可(ke)以(yi)設立(li)六個月的試用(yong)(yong)(yong)期。
