不得終止勞動合同的情形有哪些呢?

答(da) 首先(xian)勞動(dong)(dong)和(he)(he)社會保障部等部門《關于(yu)進一步推行(xing)平等協(xie)商和(he)(he)集體合(he)(he)同(tong)制(zhi)度的(de)(de)通知》規定,參(can)與(yu)(yu)(yu)(yu)集體協(xie)商簽(qian)訂(ding)集體合(he)(he)同(tong)的(de)(de)職(zhi)工(gong)協(xie)商代表在(zai)任(ren)期(qi)(qi)(qi)內(nei),勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)(qi)滿的(de)(de),企業(ye)(ye)原(yuan)則上應當與(yu)(yu)(yu)(yu)其(qi)續(xu)簽(qian)勞動(dong)(dong)合(he)(he)同(tong)至(zhi)任(ren)期(qi)(qi)(qi)屆(jie)滿。勞動(dong)(dong)者(zhe)(zhe)在(zai)醫療(liao)期(qi)(qi)(qi)、孕期(qi)(qi)(qi)、產期(qi)(qi)(qi)和(he)(he)哺乳期(qi)(qi)(qi)內(nei),勞動(dong)(dong)合(he)(he)同(tong)期(qi)(qi)(qi)限(xian)屆(jie)滿時,用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)不(bu)得(de)終(zhong)(zhong)止(zhi)(zhi)勞動(dong)(dong)合(he)(he)同(tong)。勞動(dong)(dong)合(he)(he)同(tong)的(de)(de)期(qi)(qi)(qi)限(xian)應自(zi)動(dong)(dong)延續(xu)至(zhi)醫療(liao)期(qi)(qi)(qi)、孕期(qi)(qi)(qi)、產期(qi)(qi)(qi)和(he)(he)哺乳期(qi)(qi)(qi)期(qi)(qi)(qi)滿為止(zhi)(zhi)。其(qi)次用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)不(bu)得(de)終(zhong)(zhong)止(zhi)(zhi)傷(shang)殘程度為1~6級(ji)的(de)(de)工(gong)傷(shang)職(zhi)工(gong)的(de)(de)勞動(dong)(dong)合(he)(he)同(tong),用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)對未進行(xing)離崗前職(zhi)業(ye)(ye)健(jian)康檢查的(de)(de)勞動(dong)(dong)者(zhe)(zhe)不(bu)得(de)解除或者(zhe)(zhe)終(zhong)(zhong)止(zhi)(zhi)與(yu)(yu)(yu)(yu)其(qi)訂(ding)立(li)的(de)(de)勞動(dong)(dong)合(he)(he)同(tong);用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)(wei)在(zai)疑(yi)似職(zhi)業(ye)(ye)病(bing)(bing)病(bing)(bing)人(ren)診斷或者(zhe)(zhe)醫學觀察期(qi)(qi)(qi)間(jian),不(bu)得(de)解除或者(zhe)(zhe)終(zhong)(zhong)止(zhi)(zhi)與(yu)(yu)(yu)(yu)其(qi)訂(ding)立(li)的(de)(de)勞動(dong)(dong)合(he)(he)同(tong)。
