答 如果(guo)勞(lao)(lao)動(dong)合同未到期(qi),根據(ju)《中(zhong)華人民共和(he)國和(he)勞(lao)(lao)動(dong)合同法(fa)》第四十(shi)一條規定,因(yin)勞(lao)(lao)動(dong)合同訂(ding)立時所依據(ju)的客觀(guan)經(jing)濟情況發生重大(da)變化,致使勞(lao)(lao)動(dong)合同無法(fa)履行(xing),需要裁減(jian)(jian)人員(yuan)二十(shi)人以上或者裁減(jian)(jian)不足二十(shi)人但占(zhan)企(qi)業職工(gong)(gong)總數(shu)百分之十(shi)以上的,用人單位可(ke)以經(jing)濟性(xing)裁員(yuan)。但是裁員(yuan)必須由用人單位提前(qian)三十(shi)日向工(gong)(gong)會或者全體職工(gong)(gong)說明情況,聽取工(gong)(gong)會或者職工(gong)(gong)的意見,并且(qie)裁減(jian)(jian)人員(yuan)方案經(jing)向勞(lao)(lao)動(dong)行(xing)政部門報告。
