答(da) 《勞(lao)(lao)動(dong)(dong)合同(tong)法(fa)》第四(si)十條規定,勞(lao)(lao)動(dong)(dong)合同(tong)訂立時所依據的客觀情況發(fa)生(sheng)重(zhong)大變化,致使勞(lao)(lao)動(dong)(dong)合同(tong)無法(fa)履行,經用人(ren)單位與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)協商,未能就變更勞(lao)(lao)動(dong)(dong)合同(tong)內容達成(cheng)協議的,用人(ren)單位提(ti)前三十日以書面形式(shi)通知勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)本(ben)人(ren)或者(zhe)(zhe)額外(wai)支(zhi)付勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)一個月工資后,可以解除勞(lao)(lao)動(dong)(dong)合同(tong)。
