答(da) 第一種(zhong)情況(kuang):以下(xia)情形(xing)下(xia),用(yong)(yong)人(ren)單(dan)位(wei)(wei)可以隨時(shi)解(jie)除勞動合(he)同(tong)(tong)(tong),而(er)不必履行任(ren)何手(shou)續和義務(wu): (1) 在試(shi)用(yong)(yong)期內,勞動者(zhe)(zhe)被證明不符合(he)錄(lu)用(yong)(yong)條件; (2) 勞動者(zhe)(zhe)嚴(yan)重違反勞動紀律或(huo)(huo)(huo)用(yong)(yong)人(ren)單(dan)位(wei)(wei)規章制度(du)的(de)(de); (3) 嚴(yan)重失(shi)職,營失(shi)舞弊,對(dui)用(yong)(yong)人(ren)單(dan)位(wei)(wei)利益造成重大損害的(de)(de); (4) 被依法(fa)追究刑(xing)事(shi)(shi)(shi)責任(ren)的(de)(de)。 第二(er)種(zhong)情況(kuang):用(yong)(yong)人(ren)單(dan)位(wei)(wei)有權解(jie)除勞動合(he)同(tong)(tong)(tong),但應當(dang)提前(qian)30日(ri)以書面形(xing)式通知勞動者(zhe)(zhe)本人(ren): (1)勞動者(zhe)(zhe)患病或(huo)(huo)(huo)者(zhe)(zhe)非因工(gong)(gong)負傷,醫療期滿后,不能(neng)(neng)從(cong)事(shi)(shi)(shi)原工(gong)(gong)作(zuo)也(ye)不能(neng)(neng)從(cong)事(shi)(shi)(shi)由(you)用(yong)(yong)人(ren)單(dan)位(wei)(wei)另行安排的(de)(de)工(gong)(gong)作(zuo)的(de)(de); (2)勞動者(zhe)(zhe)不能(neng)(neng)勝任(ren)工(gong)(gong)作(zuo),經(jing)過培訓或(huo)(huo)(huo)者(zhe)(zhe)調整(zheng)工(gong)(gong)作(zuo)崗位(wei)(wei),仍不能(neng)(neng)勝任(ren)工(gong)(gong)作(zuo)的(de)(de); (3)勞動合(he)同(tong)(tong)(tong)訂(ding)立時(shi)所依據(ju)的(de)(de)客觀情況(kuang)發生重大變化,致使原勞動合(he)同(tong)(tong)(tong)無(wu)法(fa)履行,經(jing)當(dang)事(shi)(shi)(shi)人(ren)協(xie)商(shang)不能(neng)(neng)就變更勞動合(he)同(tong)(tong)(tong)達成協(xie)議的(de)(de)。 第三種(zhong)情況(kuang),用(yong)(yong)人(ren)單(dan)位(wei)(wei)瀕(bin)臨破產進行法(fa)定整(zheng)頓期間(jian)或(huo)(huo)(huo)者(zhe)(zhe)生產經(jing)營狀況(kuang)發生嚴(yan)重困難(nan),確(que)需裁減人(ren)員的(de)(de),應當(dang)提前(qian)三天(tian)通知。
