答 第一種(zhong)情(qing)況(kuang):以(yi)下情(qing)形(xing)下,用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)可(ke)以(yi)隨時解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同,而(er)不必履行任(ren)(ren)何(he)手續和(he)義務(wu): (1) 在試用(yong)(yong)期內,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)被證明不符合(he)錄用(yong)(yong)條件; (2) 勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)嚴重(zhong)(zhong)違反勞(lao)動(dong)(dong)(dong)(dong)(dong)紀律或(huo)用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)規(gui)章制度的(de); (3) 嚴重(zhong)(zhong)失職(zhi),營失舞(wu)弊,對用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)利益造成重(zhong)(zhong)大(da)損(sun)害的(de); (4) 被依法(fa)追究刑事(shi)(shi)責任(ren)(ren)的(de)。 第二種(zhong)情(qing)況(kuang):用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)有權解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同,但應當(dang)提前30日以(yi)書面(mian)形(xing)式通(tong)知勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)本人(ren)(ren)(ren): (1)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)患病或(huo)者(zhe)(zhe)非因工負(fu)傷,醫療期滿后,不能從事(shi)(shi)原(yuan)工作也不能從事(shi)(shi)由用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)另行安(an)排的(de)工作的(de); (2)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)不能勝任(ren)(ren)工作,經(jing)過培訓(xun)或(huo)者(zhe)(zhe)調整工作崗位(wei)(wei),仍不能勝任(ren)(ren)工作的(de); (3)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同訂立時所(suo)依據的(de)客觀情(qing)況(kuang)發(fa)生重(zhong)(zhong)大(da)變化,致使原(yuan)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同無(wu)法(fa)履行,經(jing)當(dang)事(shi)(shi)人(ren)(ren)(ren)協商不能就變更勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同達成協議的(de)。 第三(san)種(zhong)情(qing)況(kuang),用(yong)(yong)人(ren)(ren)(ren)單(dan)位(wei)(wei)瀕臨(lin)破產進(jin)行法(fa)定整頓期間或(huo)者(zhe)(zhe)生產經(jing)營狀況(kuang)發(fa)生嚴重(zhong)(zhong)困難,確需(xu)裁減人(ren)(ren)(ren)員的(de),應當(dang)提前三(san)天(tian)通(tong)知。
