答 第(di)一種情況:以(yi)下(xia)情形下(xia),用(yong)人(ren)(ren)(ren)(ren)單位(wei)可以(yi)隨時解(jie)除勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong),而不(bu)(bu)必履行(xing)(xing)任(ren)(ren)何手續和義務(wu): (1) 在試用(yong)期(qi)內(nei),勞(lao)(lao)動(dong)(dong)(dong)(dong)者被證明不(bu)(bu)符(fu)合錄用(yong)條件; (2) 勞(lao)(lao)動(dong)(dong)(dong)(dong)者嚴重(zhong)違反勞(lao)(lao)動(dong)(dong)(dong)(dong)紀律(lv)或用(yong)人(ren)(ren)(ren)(ren)單位(wei)規章制度的(de); (3) 嚴重(zhong)失職(zhi),營失舞弊(bi),對用(yong)人(ren)(ren)(ren)(ren)單位(wei)利益造成重(zhong)大(da)損害的(de); (4) 被依法(fa)追究刑(xing)事責任(ren)(ren)的(de)。 第(di)二種情況:用(yong)人(ren)(ren)(ren)(ren)單位(wei)有權解(jie)除勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong),但(dan)應當提前(qian)30日(ri)以(yi)書面形式通知勞(lao)(lao)動(dong)(dong)(dong)(dong)者本(ben)人(ren)(ren)(ren)(ren): (1)勞(lao)(lao)動(dong)(dong)(dong)(dong)者患(huan)病或者非因工(gong)(gong)負傷,醫療(liao)期(qi)滿(man)后,不(bu)(bu)能(neng)(neng)從事原工(gong)(gong)作也不(bu)(bu)能(neng)(neng)從事由用(yong)人(ren)(ren)(ren)(ren)單位(wei)另行(xing)(xing)安排(pai)的(de)工(gong)(gong)作的(de); (2)勞(lao)(lao)動(dong)(dong)(dong)(dong)者不(bu)(bu)能(neng)(neng)勝(sheng)任(ren)(ren)工(gong)(gong)作,經(jing)過(guo)培訓或者調整工(gong)(gong)作崗位(wei),仍不(bu)(bu)能(neng)(neng)勝(sheng)任(ren)(ren)工(gong)(gong)作的(de); (3)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)訂(ding)立時所(suo)依據的(de)客觀情況發生重(zhong)大(da)變化,致使原勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)無法(fa)履行(xing)(xing),經(jing)當事人(ren)(ren)(ren)(ren)協(xie)商不(bu)(bu)能(neng)(neng)就變更(geng)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)達成協(xie)議的(de)。 第(di)三種情況,用(yong)人(ren)(ren)(ren)(ren)單位(wei)瀕臨破產(chan)進行(xing)(xing)法(fa)定整頓期(qi)間或者生產(chan)經(jing)營狀況發生嚴重(zhong)困難,確需裁(cai)減人(ren)(ren)(ren)(ren)員(yuan)的(de),應當提前(qian)三天通知。
