員工解除勞動合同,如何賠償培訓費?

我(wo)(wo)是(shi)山東一家私企的工程技(ji)術人員(yuan),前段時間(jian)公(gong)司出資讓(rang)我(wo)(wo)們參加了技(ji)術培訓,如(ru)果我(wo)(wo)主(zhu)動辭職,如(ru)何(he)賠償培訓費?

用人單位出(chu)資(zi)(zi)(zi)(指有支(zhi)(zhi)付貨幣憑證的(de)(de)(de)情況)對職工(gong)(gong)進行(xing)(xing)各類技術培訓,如果試用期(qi)滿,在合同(tong)期(qi)內,則(ze)用人單位可以(yi)(yi)要求勞(lao)動者支(zhi)(zhi)付該項培訓費用。具體支(zhi)(zhi)付方(fang)法是:約(yue)定(ding)(ding)服務(wu)期(qi)的(de)(de)(de),按服務(wu)期(qi)等(deng)分出(chu)資(zi)(zi)(zi)金額,以(yi)(yi)職工(gong)(gong)已(yi)履(lv)行(xing)(xing)的(de)(de)(de)服務(wu)期(qi)限(xian)遞(di)減支(zhi)(zhi)付;沒約(yue)定(ding)(ding)服務(wu)期(qi)的(de)(de)(de),按勞(lao)動合同(tong)期(qi)等(deng)分出(chu)資(zi)(zi)(zi)金額,以(yi)(yi)職工(gong)(gong)已(yi)履(lv)行(xing)(xing)的(de)(de)(de)合同(tong)期(qi)限(xian)遞(di)減支(zhi)(zhi)付;沒有約(yue)定(ding)(ding)合同(tong)期(qi)的(de)(de)(de),按5年服務(wu)期(qi)等(deng)分出(chu)資(zi)(zi)(zi)金額,以(yi)(yi)職工(gong)(gong)已(yi)履(lv)行(xing)(xing)的(de)(de)(de)服務(wu)期(qi)限(xian)遞(di)減支(zhi)(zhi)付;雙方(fang)對遞(di)減計算方(fang)式已(yi)有約(yue)定(ding)(ding)的(de)(de)(de),從其約(yue)定(ding)(ding)。
