出現哪些情況勞動合同可以終止?

答 (1)作為勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)一(yi)方當事人的勞動(dong)(dong)(dong)者死亡(wang),致使無(wu)法(fa)繼(ji)續履行(xing)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)規(gui)定(ding)的義務(wu),勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)終止(zhi); (2)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)在履行(xing)過(guo)程中(zhong),企(qi)業被撤銷,職(zhi)工(gong)由(you)勞動(dong)(dong)(dong)主管部門(men)另作分配,企(qi)業與(yu)職(zhi)工(gong)原來訂(ding)立的勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)終止(zhi); (3)在勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)履行(xing)過(guo)程中(zhong),企(qi)業依據《破產(chan)法(fa)(試行(xing))》的有關規(gui)定(ding),宣(xuan)(xuan)告破產(chan)。企(qi)業宣(xuan)(xuan)告破產(chan),表明此時企(qi)業已無(wu)法(fa)按(an)照勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)履行(xing)其(qi)權利和義務(wu),只能終止(zhi)勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong); (4)用人單(dan)(dan)位在招工(gong)時違反法(fa)律、法(fa)規(gui),徇私舞(wu)弊,非法(fa)招收(shou)職(zhi)工(gong),一(yi)經發(fa)現(xian),必須進(jin)行(xing)清退,隨(sui)之單(dan)(dan)位與(yu)職(zhi)工(gong)訂(ding)立的勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)(tong)即行(xing)終止(zhi)。
