答(da) 如果(guo)勞(lao)(lao)動(dong)(dong)(dong)合同被(bei)確認無效,且勞(lao)(lao)動(dong)(dong)(dong)者已(yi)付(fu)出勞(lao)(lao)動(dong)(dong)(dong)的,則用(yong)人單位應當向勞(lao)(lao)動(dong)(dong)(dong)者支付(fu)勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)。勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)的數額(e),參照本單位相同或(huo)者相近崗位勞(lao)(lao)動(dong)(dong)(dong)者的勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)確定。并(bing)且如果(guo)是因(yin)單位原因(yin)造成合同無效的,員工可以立即解除合同,并(bing)且要(yao)求(qiu)單位支付(fu)補償金。
