何時與勞動者簽訂勞動合同最合適呢?

我們是一家新創業公司,最近找(zhao)了一些新人,請問(wen),何時與(yu)勞動(dong)者(zhe)簽訂勞動(dong)合同最合適呢?

《中華人(ren)民共和國(guo)勞(lao)動(dong)(dong)(dong)合(he)同法(fa)》第八(ba)十二條規定(ding):“用(yong)人(ren)單(dan)位(wei)自用(yong)工之日起超過一(yi)個月(yue)不滿(man)一(yi)年未(wei)與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)訂立書面勞(lao)動(dong)(dong)(dong)合(he)同的(de)(de),應當向(xiang)勞(lao)動(dong)(dong)(dong)者(zhe)每月(yue)支付二倍的(de)(de)工資……” 第十四條還(huan)規定(ding):“……用(yong)人(ren)單(dan)位(wei)自用(yong)工之日起滿(man)一(yi)年不與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)訂立書面勞(lao)動(dong)(dong)(dong)合(he)同的(de)(de),視(shi)為用(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)已訂立無固定(ding)期(qi)限勞(lao)動(dong)(dong)(dong)合(he)同。” 所以,員工入職第一(yi)天就(jiu)要(yao)簽合(he)同的(de)(de)。
