何時與勞動者簽訂勞動合同最合適呢?

我(wo)們(men)是(shi)一(yi)家新創業公(gong)司(si),最(zui)近(jin)找(zhao)了一(yi)些新人,請問,何時與勞動(dong)(dong)者簽(qian)訂勞動(dong)(dong)合同最(zui)合適呢?

《中華人民共和(he)國勞動(dong)(dong)合(he)(he)(he)同(tong)法(fa)》第八十二(er)條規定:“用人單(dan)位自用工(gong)之日(ri)起超過(guo)一(yi)個月(yue)不滿一(yi)年(nian)未與勞動(dong)(dong)者訂(ding)(ding)立(li)書面勞動(dong)(dong)合(he)(he)(he)同(tong)的,應當(dang)向勞動(dong)(dong)者每(mei)月(yue)支付二(er)倍的工(gong)資……” 第十四條還規定:“……用人單(dan)位自用工(gong)之日(ri)起滿一(yi)年(nian)不與勞動(dong)(dong)者訂(ding)(ding)立(li)書面勞動(dong)(dong)合(he)(he)(he)同(tong)的,視為用人單(dan)位與勞動(dong)(dong)者已(yi)訂(ding)(ding)立(li)無固定期限勞動(dong)(dong)合(he)(he)(he)同(tong)。” 所(suo)以,員(yuan)工(gong)入職第一(yi)天就要簽合(he)(he)(he)同(tong)的。
